US Immigration from Colombia

Hi all,

My fianc e is applying for a K1 visa and thinking ahead I'm looking in to how things work once she gets here and applies for AOS. I was under the impression that she could apply for Advance Parole to be able to travel outside the US and this could be used for any reason, it didn't have to be an emergency or humanitarian situation. However, reading the instructions on the form carefully, this doesn't seem to be the case.

Specifically, the instructions state:

You must complete Part 4. of the form indicating how your intended travel fits within 1 of the 3 purposes below. You must also provide evidence of your reason for travel outside of the United States including the dates of travel and the expected duration outside the United States. If your advance parole application is approved, the validity dates of your Advance Parole Document will be for the duration of the documented need for travel. Below are examples of acceptable evidence: Educational Purposes (a) A letter from a school employee acting in an official capacity describing the purpose of the travel and explaining why travel is required or beneficial; or (b) A document showing enrollment in an educational program requiring travel. Employment Purposes A letter from your employer or a conference host describing the need for the travel. Humanitarian Purposes (a) A letter from your physician explaining the nature of your medical condition, the specific medical treatment to be sought outside of the United States, and a brief explanation why travel outside the U.S. is medically necessary; or (b) Documentation of a family member s serious illness or death.

So if we wanted to travel just for leisure, obviously she wouldn't fit in to any of those categories. Can anybody confirm if this is indeed the case that she must strictly fit in to one of those categories, or if there is some flexibility for leisure travel?

Well, my wife passed the Civics test and the English reading and writing part of the test in Feb, but failed the understanding English part of the test (the N-400) as she did not remember her whole phone number and had a problem answering the number of trips abroad question. Those were the only questions.

She re-took the understanding English re-do just last week. After extensive studying her N-400 ,she failed. From her description the agent asked 1 question and It sounded like she got it right (Why do you want to become a citizen). She answered "to vote". Was then asked to explain and she got confused and answered again "to vote". No good, sent to the office to see the agent's boss and was told she failed.

We just got the letter, and it mentioned a possibility of a hearing----of course for an extra fee.

Has anybody requested one? Know of anybody who has? Results?

At this point, should we get a lawyer? I need to check locally, but any idea on a price range for a lawyer and if one is worth it? I might have thought wrong but I was always under the impression that a lawyer is good for you if you are bad with paperwork and can help in explaining things but I thought they cant be involved in the test/interview? Or have I been wrong? Up to her citizen attempts (she is terrible at tests) everything has been easy. I must have killed a whole forest on her initial petition for residency making sure all forms were perfect and kept ALL records of our life together back then.

Any ideas. She is really feeling down about this.

I respectfully looked and researched before asking this.

My wife and I, in the USA, are trying to get b2 tourist visas for her brother and nephew who live in Colombia. I filed 2 separate visas (nephew is 21, dad is 53) so as one doesn't potentially knock the other out of getting approved.

I think i made a mistake. I paid for the visas tonight but didn't set the appointments yet. My question is...does anyone know how or if i can schedule their appointments together in Bogota or did i screw myself by filing and paying the fees before finding the answer to my question?

My wife's mother passed away when my wife was 12 years old. Her grandmother (mother's mother) took legal custody of her. When my wife becomes a US Citizen, is there any chance that she can petition for her grandmother who was legally her parent?

This question I am sure it has been asked before and I can't find it after searching. I have applied for my wife and the children to have the conditions removed from their conditional green cards. In January 2024 we received an I-751 RFE, so I sent in more proof of a legitimate marriage, (about a ream of paper), along with affidavits, tax forms, lawsuit docket, adoption hearing ect. In the meantime, my wife has suffered many health issues, (currently engaged in a medical malpractice suit), where several times she was on the brink of death. The son is 22 now so I wasn't too worried about him, but the daughter is 13 and we feared if something happened to my wife, she would be sent back to her biological father who didn't want her and abused her when she was small. Through the Colombian and US courts we got him to cede all parental rights and on March 27, 2024 the daughter was officially adopted with my last name. Having said all that, what do I need to do in order to get her a US passport, and to terminate the 'Removal of Conditions' for her? I thought it wasn't too involved and I don't know what happened to the thread, (bad memory cells on my part), so please forgive me for the redundancy.
