Question about scheduling for AOS (green card) interview

Sent in AOS package in October 2019. Status updated to "read to be scheduled for interview" in March 2020, but no change since then, and expecting it to be a while since the office processing our case (San Francisco) had the longest average wait times in the US last we checked.

My question is looking ahead to that time, whenever it may be, when they're finally ready to schedule the interview. At that point, does USCIS simply assign a time and it's up to us to be there at that assigned time? Or are we given a choice of times on an online calendar (like she was for the K1 interview at the overseas consulate)?

Hey VJ community,


I am new and probably at one point someone had post this, sorry for re-posting. English isn't my first language so excuse my grammer. So far I been reading guides and forums for the last few days, I just want to make sure I have everything in order before I start this process. I like to be organize and have things plan out so excuse the long story. I am born and raise in USA and plan to marry my girlfriend of 2 years who currently is living in Guangzhou, China. I guess the first step is to get a "Single Status Affidavit" notarize by my state and the Chinese consulate, which I never done but guess it's the first time for everything. I heard that this only last three months so I haven't done it since I don't know when I can return to China due to travel ban. Bring my birth certificate, passport, 3 photo of us together, hukou book, and then tied the knot in China. I assuming after all this once done and over I can start CR-1 or K3. So I read that rarely do people get a K3 issue yet I read that K3 is faster approved than CR1 which I am not even sure what to believe now. My girlfriend wants to come and live with me so we been looking at K3 since it gives us the fastest route to meet our goals. After analyzing the numbers on VJ statistic I feel that there is no difference in K3 and CR1 approval so why not just go CR1? I also read on the forum people had sent two of the form out I-130 and I-129F seeing which ones get approve first, which I-130 has seem to being approved first. Saying so can I do this forms right after we get marry in China via online or do I need to return home? At first for th CR-1 I had thought that the green card was permanent residence but it is only conditional which I will have to do a I-751 eventually? When do people usually do this? After 2 years of marriage or when the green card is about to expire? Does my girlfriend need to fill out anything after I sent the I-130 and got it approve and move on to I-130A? Seems like it's just the interview afterward with her documents forms needed correct? I notice there are also a lot professional service for this process but cost quiet a bit, does anyone know if they make the process much faster? If I am missing anything, please educate me.

Questions about OPT grace period and i485

I m applying for AOS based on marriage to a USC, and I have some questions that need to be clarified.
A little background about myself, I was a F1 student and was working on OPT for the past year, OPT expired on July 11, 2020 and I m currently on the 60-day grace period, which ends on September 9, 2020. My most recent entry to the US was in November last year, and I entered as OPT.

On page 2 of the form, item 23c, it asks my status on form i94, should I put F1? Somehow my form only allows me to put letters and space in it... but I guess I can just hand write it when I print it out (if F1 is what I should put in there)
On page 3 item 24, what is your current immigration status, should I put out if status ? Or something else? As I mentioned earlier, my opt has already expired but I m still in grace period, which allows me to stay here legally.
And on page 11 item 17, have you ever violated the terms or conditions of your Nonimmigrant status, should I check yes or no? I assume I can check no as long as I submit the application before my grace period runs out? If that s the case (checking no on that question), should I still include an explanation on my current opt status?
And as for my i20, my most recent one states that I ve applied for OPT, but it doesn t show my employment information during OPT, does that matter? Or should I get a more updated one?
Also did anyone file recently? Did you include the form i944? I understand there s some updates that only 3 states are exempted, but it s not official yet according to the USCIS website? I have most of the documents ready but would still like to skip this step.

I m trying to send my application by next weekend before my OPT grace period runs out, or at least before the fee change. Thanks a lot in advance! Any help would be appreciated!

Differences when filling out forms i-131 and i-765 the first time vs. for renewal

I'm getting ready to help my wife file for renewal of her EAD/AP combo card. I realize that there's already another thread on this forum on this same topic, and I apologize for starting yet another thread on this topic, but in the past I've been accused of "hijacking" other peoples' threads, so I didn't want that to happen again.

I'm writing this because I've noticed that there are a few items on forms i-131 and i-765 where the way it's filled out looks like it differs between the first time you fill it out (concurrently with the AOS package, form i-485, etc) vs. when you fill it out the second (or third?!@) time i.e. for renewal (for those of us whose AOS process drags out for more than a year).Below I've summarized the differences that I've found. Have others found the same results as me? Is there anything else I've missed. This goes for both the old version of form i-765, and the new version that was just released this month. All other items not listed above should be the same in both versions (unless you've changed your address, in which case you should update that)

Here's what I found:

For Form i-765 (employment authorization)

part 1

1. First time: Check a (initial permission to accept employment);

Renewal: Check c (renewal of my permission to accept employment)

part 2

12. First time: Check No

Renewal: Check Check Yes

13-17. First time: No for 13a, skip 13b, Yes for 14, fill out 15-17

Renewal: Yes for 13a, fill out 13b, No for 14, skip 15-17

For Form i-131 (advanced parole)

part 1

9. First time: Leave blank

Renewal: Fill out SSN

part 3

1-2. Update info as needed

4a. First time: No

Renewal: Yes

4b. First time: leave blank

Renewal: Fill in Date issued (is this the Valid from date on the card itself?)

4c. First time: leave blank

Renewal: Under disposition write attached and attach copies

Spillover of FB immigration visas due to visa ban under EO to EB quota

Like said in the title, I haven't seen any discussion on VJ about the unused visa quota from FB categories in FY2020 to be given to EB quota in FY2021.

It says there is an extra quota of at least 60K visas available to EB in FY2021 due to the immigration travel ban and most FB immigrants going through consular processing.

I know on this forum FB immigration is the majority. Just curious what people think about the huge spillover (due to this exceptional pandemic).
