W-7 FORM FOR INDIA

Timeline

Can somebody describe the procedure for getting an ITIN number is India so you can claim your spouse for IRS tax return.

I did check the U.S embassy website to see what the procedures …are. form the embassy description it seems very simple but so far that is not the case

1. so far what I know it I need to pay the in HDFC bank before making an appointment …

2. Do I need the copy of the Indian passport notarized in an Indian embassy before?? Going to U.S embassy

If anybody have done this already please advice on the procedures

If you are still resident in India, there simply is no Indian Embassy that you can even visit first in your own country.... Embassies are government representatives to a foreign country.... located in foreigh countries....

if you are a spouse of us citizen, your US spouse file it with the irs

you have to submit a copy of your passport, w7 and us tax form to the irs in the w7 mailing instruction

they give u an itin number and complete your return for you

guys, i an the U.S citizen ... i am asking help for my wife ?? i know i need a certified true copy of my wife’s Indian Passport…

unfortunately in India it now a walk-in procedure ….. she can’t just walk into the embassy and ask for it ?? it doesn’t work that way ……..

anybody form India has gotten W-7 for their spouses ??

To me My last tax file with her Name is as important as our birth certificate …to prove legal marriage ….

Any help would be appreciate

My answer still stands... There is no other embassy/consulate for her to visit BEFORE going to the US Embassy/Consulate to have the documents notarized....

I am filing a W-7 for ITIN this year and have spoken to the IRS for help...you have to have a notarized copy of the passport (my husband had to go to the Chennai to the american embassy. cost is 30$, no appt nessesary)

Who should sign it

the foriegn spouse signs it and sends american embassy notarized copy of passport to us citizen to be filed with usa tax forms. all instructions can be found at the irs website and if there are any further questions you can talk with a representative at the irs. the phone number is on the website (not always easy to talk to operator and this time of year could be real tough).

u can get the w7 off the irs website, ahmed filled out over there, signed, sent with his passport copy back to me and i took it to the tax preparer , it will then go along with my tax infor to the irs (after he signs the return also)

Timeline

You must have your wife fill out a copy of the W-7 tax form. You must also have her to go the United States embassy and get a notarized photocopy of her passport pages. She will then send these to you. When you file your taxes, you will include the W-7 form and the notarized passport photocopies with your return. Additionally, if your wife has any foreign income, you must fill out a form 2555 (Foreign Earned Income). Generally, if India has a tax treaty with the United States, your wife's income will be exempt from US taxes up to a certain amount (I think around $84,500). I also believe you have to include a letter that states that you are married and wish to declare your non-resident spouse as a resident for tax purposes.

I would highly recommend taxing your taxes to a CPA this year!!!!

The cost of a CPA is worth it, since you can have your spouse claim residency for tax purposes, and you can file married joint. There are some threads further down that talk a lot about taxes that you might find useful.

IRS specifically said from notary from US embassy if your spouse in outside USA. But I would call IRS to ask about your specific cirumstances.

sorry to hijack the thread... I asked my wife in Japan to send me a notorized copy of her passport for use with the W-7, but she says it is illegal to copy passport in Japan. I know this sounds crazy. Assuming she is correct, how do I file proper documentation with the W-7?

Does anyone know what the rules are in Japan?

the people at the embassy would know the rules in japan...I would have her go and ask them how to get proof for filing joint taxes in USA, I am sure they will have the answers.
