PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this
When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1."  The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!).  I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!

Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before....  I would kindly remind the officer "We married >2 years ago.  We can enter with an IR-1 visa now right?"

Traveled to Canada for 20 days after entering the U.S. on a K-1 visa (June 1–22). Seeking reentry under Automatic Visa Revalidation (AVR).
I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?

Wrong USCIS application form filed by my lawyer!
Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…

Seeking advice for Thai/US couple - What US visa path to take?
My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it
Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?

US Citizen with Foreign Fiancé: When and How to Get Married?
I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?

    Hey VisaJourney Community,

I am looking for some advice on if there s anything I can do to get my case pushed through. I am the USC petitioner on a K1 visa application to bring my fianc here from Argentina. I have a federal criminal conviction from 2018 that was fully disclosed on our application with certified court records.

We received our NOA1 on 01-27-2025.

We received an I-797C requesting biometrics from the petitioner on 09-19-2025.

I completed the biometrics appointment on 10-17-2025.

I was following the processing timelines and availability to send a case inquiry on the USCIS site. I sent a case inquiry on 02-28-2026. As of this writing we have not heard anything back.

I m wondering if anyone has experience in something similar or any suggestions as to what we can do? We feel like we are in the dark and stuck in an endless wait. Are there any steps we should take or do we just have to tough it out and wait?

Thanks in advance for your help!!

Got approval for my parents' I-130. Right before that, the State Department indefinitely paused issuing green cards for their country (Russia). Processing still continues - fees, DS-260, interview in Poland etc. They both possess one more citizenship, from a country not included in the 75. On DS-260 still have to show Russian address etc because that is where they actually reside, and listed the second citizenship. Can this second citizenship help with going around the pause?

Hello, I came through the site and I would like to start a service!

    Hello! Good morning!

My name is Nosilaht, and the reason for my contact is. My brother is as a tourist in Toronto, Canada 2 years and 10 months, so far, he is legally as a tourist. He has been working as a service provider as a driver. He was working without a work permit.

In January 2026, he married an American citizen, and we remain married. They want to apply for the green card process. They meet every 15 days, sometimes also on Saturdays of each week.

He has already seen as an American tourist B2, but at the moment he is defeated. He was in the United States in 2019 and stayed 5 months and 26 days, he did not pass the 6-month period. And the aggravating factor is that he worked sporadically there.

    However, there are three situations:

1- Having worked in the United States without permission.

2- He was working without a permit in Canada. He received the invoice here in the service provision in Canada. It has an open Trade Name (Company).

3- He is outside his country of origin, he has citizenship that is Brail. He would not like to return to Brazil to have to apply from there, because of the financial situation there. But if there is no way to apply from Canada, since it is almost 3 years and legally, he returns to Brazil and tries the species to get approved.

I would like to ask a question, has anyone ever gone through a situation like this or similar to my brother?

I will be very grateful with the answer.

How to submit more than 10 documents when replying to RFE online

Hi! My husband submitted an I-751 back in 2023 and we recently received a response from USCIS that we need to provide additional information. In his USCIS account, we see that he can respond to the RFE online, which is great, but it says that it is limited to only 10 documents, and we have more than 10 documents, because we want to ensure we provide enough evidence this time. The letter we received said that we needed to include the letter itself, and we have a cover letter explaining all of the documents, so it seems like we actually can only upload 8 documents, unless I am missing something?

There is some instruction about if you have other documents, you can upload them under the Documents tab as "unsolicited documents", but will they even look at these other documents then? I am attaching a screenshot of the instructions from the website.

Any advice on how we should handle uploading the documents? Should we just prioritize the ones we feel are the best evidence and submit those?

    Thank you!

We have our interview coming up end of April.

My brother and sister-in-law are the co-sponsors for my husband and step-daughter.

    Should they come with us?

The instructions say to bring all of the documentation "unless already submitted."

    We already gave them everything.

Should we print it all out and bring it again or will they even look at it?

I know I must bring our marriage certificate, his, my and step-daughters birth certificates v and translations for theirs. I'm assuming my and his divorce decrees and translation for his.

I've already submitted all this but the form does not say "unnless already submitted" here, so I'll bring it again.

I was thinking of uploading photos of us together at random events taken since the packet was sent. Should I bring hard copies as well?

What's suggested. Should I really bring a second copy of everything they already have?

Do I need to bring my brother and sister-in-laws birth certificates as well, even though copies were sent?

It mentions letters from their employers proving employment and pay rate, is this a requirement or just one of the options for proving income.

We did already send in their tax transcripts for past 3 years.

I was thinking of bringing their income tax transcript for 2025 (I had sent '24, '23, and '22) So would that suffice or will they have to get letters from their employers as well?

And again, should they come with us?

    TIA!

Edited to add: We applied for work auth for both of them at the time we sent the original packet. We haven't heard anything and the site shows only "current."

Does anyone know if they are even doing work auths? How long after the interview do people usually get the green card. If I'm not mistaken, that serves as work auth as well, correct?

Hello @RSJRGT: You made a post on the thread for appointments in Ciudad Juarez recently. I just noticed that many people with DQ dates in February and march are announcing online that they received appointment notifications in the past 2 days. I wanted to check if you have received any e-mails from NVC.

      Hi everyone,
For those who recently received the status “Case Was Sent to the Department of State” from USCIS — how long did it take you to receive your NVC case number / Welcome Letter?
