When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 19 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

8 RepliesI am currently filing my Fathers I-130 application. My father is a Mexican born Citizen, he came to the US undocumented and still currently resides in the US.
When filling out the Beneficiary s Physical Address, should I put his Mexico address or his US address?
Also, I should note he was deported back to Mexico in 2009, then came back to the US undocumented. Any advice would be helpful.

6 RepliesDisclaimer: I come from a culture where living in a joint family system is common. You might guess, yes, it's an Asian culture. Nothing wrong with living this way AFAIK, other than seeming weird to some folks. In my opinion it's not too bad if the house is big enough for a multi-generational family.
Anyways... I'm a USC and my wife has a CR1. We consider ourselves residents of place 'A'. We have a joint lease, joint taxes, joint bank account, joint health insurance at 'A'. I have a driver license for this state but she doesn't because she doesn't drive yet. I work remotely but my company has an office here and she's a stay at home wife.
Wife got pregnant and we wanted to have the baby at my parents house in a neighboring state (let's call it place 'B'). Since I can work remotely from anywhere in US, and the state of place 'A' lets me remain a domicile resident as long as I intend to return there, we essentially went and started living with parents at 'B', gave birth and it's been 3 months since then. I didn't realize I should change wife's address, because it was a temporary stay and we still have a lease/joint bank/insurance in place 'A' and go back there from time to time.
Question is, should I file a 6-month late AR-11 for wife? Or should I not file because we didn't 'officially' move to my parent's house in city B? We never intended to remain at B this long. AR-11 says you need to file even if its a temporary move, which I didn't realize initially... Should we not file it at all because we didn't intend to move to B? Or just be 'honest' and do a late filing? I'm now stressed about deportation, etc because they didn't use to pursue these issues, but now they might.
Additional info: During all this time, my parents and I closed on a house that I helped them purchase; it'll be in my parents name but we will rent from them. So next month, me, my wife + child and my parents are moving to a large permanent home, in the same state as 'A', but in a different city (let's call it place 'C'). At C, my wife and I will have everything together: Joint lease, utility bills, bank, health and car insurance, matching driver's licenses, etc. And we will never come back to 'B'.
We plan to file wife's I-751 at the end of Jan 2026.

2 RepliesHi, all. My wife (Filipina) and I (US citizen) embarked on the Filipino name change rigmarole just recently. I have an I-130 petition in progress, FWIW. Tomorrow, my wife was scheduled to visit the DFA to change her name on her passport to her married name, which would be the first of several name change efforts. Unfortunately, after booking the non-refundable DFA appointment and hostel stay (she's traveling to Dumaguete from the Cebu area as the Cebu DFA is completely booked out several months), she learned a surprise requirement that isn't found on the DFA website: she has to have attended the CFO PDOS seminar! Now here's the problem: the CFO's scheduling website requires visa number and visa expiration date! She doesn't have her visa yet, so we don't know what to do. We did some additional research and found several non-DFA online references to having to complete the CFO seminar before the DFA allows passport name changes. Has anyone run into this problem? How do we proceed?
An additional question is will she have to attend the PDOS again later on when her visa is approved, or can she just go back to the CFO office to get a sticker on her then-changed passport (although I remember reading that CFO doesn't issue stickers anymore)?
Gripe: Please, DFA. Please update your requirements to be accurate for spouses of foreigners. We could've saved PHP 1000 plus the hostel booking if you just better documented your own processes.

I got my I-751 approved and received a 10-year green card. I applied for N-400 in March 2025 and finally have my interview scheduled in a few days.
I want to get advice on what to prepare for:
- Is the civics test still the 2008 version?
- Are there any moral character documents I should bring?
- Should I bring originals of all documents submitted with my N-400?
- My husband will accompany me will he be asked questions or interviewed along with me?
- Any tips for the English and civics test or typical interview questions?
- Any recent experiences or changes in USCIS procedures that I should be aware of?
Any advice or guidance from anyone with recent experience would be greatly appreciated.
