When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 20 replies
Traveled to Canada for 20 days after entering the U.S. on a K-1 visa (June 1–22). Seeking reentry under Automatic Visa Revalidation (AVR).

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

US Citizen with Foreign Fiancé: When and How to Get Married?

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

3 RepliesI entered the U.S. in February 2024, and at the time of entry my spouse and I had already been married for more than two years. Because of that, I should have been classified as IR-1 and issued a 10-year permanent resident green card, not a 2-year conditional card.
However, USCIS initially issued me a 2-year conditional green card, which we knew was incorrect. To fix this USCIS error, we filed Form I-90 (Application to Replace Permanent Resident Card). USCIS shows they received the I-90 on March 28, 2024 (this date appears on the I-90 receipt notice). After that, USCIS corrected the error and I received the proper 10-year green card.
Later in the year, however, we unexpectedly received a Removal of Conditions notice, referencing a deadline in February, which confused us because removal of conditions only applies to people who truly have a conditional green card and my conditional card had already been corrected to a 10-year card.
Because of that notice, we contacted our state representative and asked them to submit an inquiry to USCIS for clarification. USCIS responded through the state representative and confirmed that I do have the correct 10-year green card and that my classification is correct.
What is still confusing is that in the USCIS response, the USCIS officer specifically wrote that the I-90 was approved on March 14, 2024. This date appears directly in the officer s written response at the bottom of the congressional letter. This is earlier than the March 28, 2024 I-90 receipt date shown on my receipt notice, and my USCIS online account shows the card being produced later (in May 2024).
So it appears USCIS may be referencing an internal decision or classification correction date (March 14) versus the I-90 receipt date (March 28) and the card production date (May). The end result is correct I received the 10-year card but the different dates and the later Removal of Conditions notice made it feel like the system still had me flagged as conditional somewhere.
could it be that caught the error earlier and retro the i90?

4 RepliesHi all, we noticed the IOE number on the Green Card and EAD Card are different by one number. I assume that it is because they are based on sequential application documents, but want to double check that is not some error we need to address.
Example:
EAD has IOE number:

IOE*********2Othe than the final number, all numbers are the same. Is this normal?

WASHINGTON The Department of Homeland Security and U.S. Citizenship and Immigration Services have launched Operation PARRIS in Minnesota, a sweeping initiative reexamining thousands of refugee cases through new background checks and intensive verification of refugee claims. They have now begun referring cases of fraud and other crimes to Immigration and Customs Enforcement (ICE).
The initial focus is on Minnesota s 5,600 refugees who have not yet been given lawful permanent resident status (Green Cards). USCIS newly established vetting center is leading Operation PARRIS (Post-Admission Refugee Reverification and Integrity Strengthening), with adjudicators conducting thorough background checks, reinterviews, and merit reviews of refugee claims.
Minnesota is ground zero for the war on fraud, said a DHS spokesperson. This operation in Minnesota demonstrates that the Trump administration will not stand idly by as the U.S. immigration system is weaponized by those seeking to defraud the American people. American citizens and the rule of law come first, always.
Begun in mid-December and now referring cases to ICE, Operation PARRIS is part of a broader strategy to implement enhanced screening standards under Executive Order 14161 and Presidential Proclamation 10949. These directives require federal agencies to identify and implement new vetting enhancements to safeguard the nation from foreign terrorists and other public safety threats.
USCIS efforts in Minnesota build on the success of Operation Twin Shield, a recent investigation that uncovered widespread immigration fraud in the Minneapolis-Saint Paul area. The agency remains committed to conducting maximum vetting of all aliens, rooting out fraud, and ensuring the safety of all Americans.

4 RepliesI'm trying to figure out when we can starting filling the DS-160 and any other documentation. Do you have to wait until the case reaches the foreign embassy and you get a welcome letter from the foreign embassy saying they are ready? I thought you could fill it when you get a case number from NVC, but here's my issue...
- I kept reaching out to NVC via their public inquiry and they finally told me that they got my petition from USCIS and they gave me my case number and invoice ID. However, when I go to CEAC login, after entering those two pieces of information I simply get a generic page about the k-1 visa: "K visas are nonimmigrant visas that assist spouses or future spouses of American citizens in entering the United States. As with all nonimmigrant visa applicants, a DS-160 must be filled out in order for a consular section to process the case." and there's an OK button at the bottom of that page. Not helpful. Doesn't log me into anything specific to me. And If I try to check my status in CEAC via their status check page, I run into a different issue: If I choose NON-IMMIGRANT visa type, I get "Invalid Application ID or Case Number." If I choose IMMIGRANT visa type, I get "Your search did not return any data." Is that because they haven't sent it to the foreign embassy yet? Or it hasn't finished being registered in their system? I'm not sure.
I see that I could go start filling in the DS-160 application online, but if I'm understanding my research correctly, I think that's a bad idea until I officially get told to do that.
I'm just not understanding the timing. I know that I have to be patient, but I also don't want to be sitting around waiting when I could've been working on documentation. So what are my next steps, if any?
Additional info:
- In their email response to my public inquiry, NVC said "Due to your petition type, you will not receive a request for fee payment or document submission." That really confuses me. I'm 100% sure my fiance has to fill out a DS-160, so does that just mean that I myself won't be asked to submit any documents? I don't know why their communication is so unclear to me.
- Also, they said "All case parties will be notified when this petition is forwarded to the assigned U.S. Embassy/Consulate General." So that leads me to believe I should just keep waiting I guess.

3 Repliesregarding the Canadian police record check on the travel state gov website at says that "The following documents WILL NOT be accepted: Type of Criminal Record Check for Personal Use: Visa-Border Crossing, Foreign Travel, Work document." and they want "Sub-type: Other (Provide Details)", my husband went to his local station to ask about it and said he wanted the subtype other and when asked for details he said immigration but was told there were multiple types. what type is he supposed to say exactly? he even showed the example document but they could not help him further.
