When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 19 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

4 RepliesSputum test was negative about 2 months ago but as part of their normal process, they sent a lab smear test to sit for 2 months. The results of this test were supposed to have been emailed to her yesterday, on Friday. After she receives the results of the 2 month lab work, she is supposed to then receive her vaccines and continue with remaining medical clearance. The results didn't come yesterday. Is it possible for these results to come over the weekend? We are concerned because her flight leaves Manila to go back home on 9/26. We are worried that the results will for some reason not come in time. She has been checking her spam and junk folders regularly. Does anyone have any experience in this?
I called +63 2 8521 0020 and spoke to some security person who says there is nobody to speak to because they are closed for the weekend.
I wonder if I should go ahead and email inquiry@slec.ph
Any insight is greatly appreciated.

Concerned about K1 Visa with "high fraud" country (Brazil) 1:41 pm today

My fiancee and I are concerned about the "proof of meeting in person" and the "proof of relationship" portions of the K1 application. She is from Brazil, which is apparently seen as a "high fraud risk" country. As such, we have seen some advice on these two points, and also paid for a consultant to review our K1 packet. But I'm finding it very hard to know who to believe, and we have slightly different views as to how lengthy and detailed to make the "proof of meeting in person" description.
Some concerns around our particular situation include:
* Our relationship is short -- we met in June of this year. In August we spent an amazing week together in Brazil, after which I proposed without hesitation (she is absolutely the one). I will be moving to Brazil in December for us to live together for 6 months while we wait for the K1. I am hoping that this will assist the interview if and when she gets to that point, but at the point of submitting the K1, we just have that one week of in-person time (and of course a lot of WhatsApp texts and calls).* She drives for a version of Uber in Brazil, after some complications due to both Covid and law changes in Brazil forced her exit from her earlier career, so she doesn't have a long full time employment history to show in the 5 year span.
* The consultant remarked that there is also a risk as she has been married to a foreigner before (not from the US, over a decade ago)
The consultant's suggestion is to keep it relatively short, but also said we need to make it feel "real". Our current version feels very "legal" due to other suggestions I had read on here and other sources.
Does anyone have experience submitting for a "high fraud" risk country, and have ideas about what to include for these two requirements?

My I-751 (filled jointly) has been pending for more than 1.5 years, and unfortunately, it looks like we'll be divorcing. I'm in California and the divorce process here takes at least 6 months (waiting period) before it's finalized, and in my case it could take even longer - possible up to 2 years (expecting for the worst).
My questions are:
1. When should I notify USCIS and convert my case to a divorce waiver?
2. If i file the waiver as soon as divorce case is open and USCIS sends me an RFE, I may not be able to provide the final divorce decree in time. Should I wait until the divorce is closer to being finalized before I switch?
3. What if i get scheduled for the interview while still in the divorce process? Can I attend the interview on my own and request to convert my petition to a divorce waiver there?
