When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 19 replies
Traveled to Canada for 20 days after entering the U.S. on a K-1 visa (June 1–22). Seeking reentry under Automatic Visa Revalidation (AVR).

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

3 RepliesHello I was hoping to get some opinion regarding of whether to submit the K1 visa after my fiance leaves the country which will be in couple days and submit it the day he leaves or before or just wait for him to leave the country to file it to USCIS. Also, I am changing address in the next 2 weeks and did anyone had an issue of changing their address through USCIS. Do I just log in the account and change it? will it delay the process once its submitted with the old address but then changing it in the next 2 weeks. Thank you and I appreciate your insights. thanks.

5 RepliesWhat can I expect if my spouse's 1-30 CR-1 is being processed at the Vermont Service Center, my step-son's K-3 is being processed in Nebraska Service Center, and my step-daughter's K-3 is being processed in the Texas Service Center? All of the petitions are tied together with each other through petition reference, but I am curious how the USCIS processes spouses with minor children when the petitions are scattered all over the country and have similar but different processing times?

2 RepliesI wanted to make a quick post about my wife's experience a few weeks ago during her citizenship interview to maybe save anyone else in a similar situation some time. My wife (K1) and step daughter (K2) filed for removal of conditions back in June of 2023. She received an extension letter for her Permanent Resident card in response. We decided it was best for her to just go ahead and file her N 400 (citizenship) in April of this year and do a combo interview. Her citizenship interview was this month at the Kansas City office. She attended and answered all of the questions correctly and was recommended for approval. When she went back out to the main counter to get a swearing in ceremony date and time they asked where our daughter was. She told them our daughter was at school where she should be on a Tuesday morning at 9am. We were then informed about the Alien Registration Requirement (https://www.uscis.gov/alienregistration) passed this year that requires anyone 14 years of age or older to recomplete all of their biometrics.
We offered to go get her from school and bring her back but were told we will need a new appointment and they will send a letter. This is our fault for not keeping up with the new requirements, but in my opinion there have been so many recent changes it is difficult for average people who are working and taking care of their family. We were never informed with any notices, emails, or even the appointment letter that our daughter would also need to attend the interview for biometrics. If you have any children who were part of the immigration process that are 14 years of age or will be 14 years of age as of the time of your citizenship interview, make sure you go through the G-325R Biographic Information Registration process as shown in the link I pasted above.

4 RepliesRelative has a reentry permit that expired ~2 years ago. Their physical green card is still valid. I am aware of the resident status impact. Relative was stuck overseas due to caring for a chronically ill relative and other family related obligations.
Some have posted that they were able to board and travel to the US. The question is, what are the chances that they would be allowed entry? I am aware that they can have an immigration judge decide what their status would be, but the issue is that entry may simply be denied? Is SB-1 a better option?

I married with my white American wife in 2015 in islamabad/ pakistan we did court marriage because of some reason after one year I had interview at islamabad embassy . interview went mix good and bad because lack of marriage pics here in our culture marriages are very traditional and full of joy and we treat like family event and gathering but in our case we had few of our pics in short counsler gave me 221g page submitted evidence w2 certificate and w2 tax returns which I was not able to submitted on the time after six months ours case has been send back to nvc .
After that so much things happens we both busy on our life and faced covid she got sick there and I was busy with my life in working and did my MBA now In 2025 after 10 years we want to submit out case again we just met once at married after that we did not see each other's physically
kindly advise us that now we have to start over again ? It more doffult now or we get any compensation they will treat our case the same way they did last time . We have to organize our marriage ceremony as traditional way or there is not need for marriage ceremony or more family photos and personal photos kindly advise us what we have to do in this stage after 10 years . I am so worried any your small advise will be very very helpful thank you so much !!
