Tourist Visa Approved - CR1 Pending

Hello

I am very happy to say that my husband had his tourist visa interview today and was approved, Meanwhile we have a CR1 petition pending.

He was very honest with the officer and we used the I130 petition in our favor.

He is a young male, we do not own property and we have middle class income and we still were :dance: approved.

So I just wanted to say that it can be done and everyone who wants to apply for one should give it their best shot. It is surely worth the try.

In Spanish there is a saying:

"El peor intento es el que no se hace"

Good for you! Were you able to go to the interview with him? Any other suggestions? I want to have my wife apply for a tourist visa again - she was turned down prior to our marriage. Thanks!

That's really good for your husband! I haven't heard of anyone who has tried for a tourist visa during the CR1 process who actually go approved. But, remember that the POE can turn your husband away! I'd suggest bringing lots and lots of evidence that your husband has ties back home (letter from employer, utility bills, rent payments etc)

This is the information I gathered:

Notarized Letter of assurance of return to C.R.

DS 156

DS 157

All Bank Accounts with last three month activity

A letter from our landlord

Affidavit of our Personal property,Income and Vehicles anything we own

Notarized Letter of Invitation from my family

Sponsor Information( I 134 and tax returns)

Evidence of why he wanted to travel ( I included my sisters wedding invitation, hotel contract, cake, flower, decoration and video contracts)

Notarized letter from my sisters Fiance saying that he was the best man at our wedding

certificate of no penal records (for me not my husband)

Proof of his employment

Photographs of us with my family when visited us in Costa Rica and photos of him with his family.

( Since I can work from anywhere as long as I have internet, this meant a lot to the officer. The fact that I live in Costa Rica and work from here helped a lot.)

I do not want to discourage you but you are still playing with fire. The immigrant intent is clear, if it is discovered at the port of entry that he has a CR1 pending he will be sent back for sure.

why?? you can't say for sure... yes, it is up to the POE officer but it isn't a given that you will be sent back if you have a pending case... I think that might be more in your favour because it shows you are doing things the right way....

That's not exaclty true, I have entered the states with my CR1 pending on 3 occassions. I was very honest about my reason for being there and my intentions while I was there (simply to visit my husband) and the fact that all of our paperwork had been submitted and was pending. i was questioned on visits 2 and 3, but they saw that my visit was legitimate and let me pass through on all occassions!

why?? you can't say for sure... yes, it is up to the POE officer but it isn't a given that you will be sent back if you have a pending case... I think that might be more in your favour because it shows you are doing things the right way....

The last time I visited the US, with our then newborn and hubby by my side the CBP was actually more compelled to let admit me because we had all our paperwork with us. His exact words to my husband were " Well, you know what you have to do".

That's not exaclty true, I have entered the states with my CR1 pending on 3 occassions. I was very honest about my reason for being there and my intentions while I was there (simply to visit my husband) and the fact that all of our paperwork had been submitted and was pending. i was questioned

on visits 2 and 3, but they saw that my visit was legitimate and let me pass through on all occassions!

I was not even able to go into the building. I could not even wait in front of the building once he went in. The interview was in spanish. He dressed kind of nice, long sleeve shirt and khaki pants. It was fast and they ask very specific questions, although he practiced for all types of questions. You should look at the website Path 2 USA, it helped me a lot. Fill out the form completely, with the picture and signature it saves a lot of time.
