Hi i'm hopeing someone can help me with a couple of questions :help:

Hubby and I are about to file the I-130 paperwork for myself and my two children, but the question concerns is it worth doing yet, as he is still a LPR. He has had his citizenship interview, which was in October 2005, but is still waiting for his oath.

Do we file now, or would it be best to wait until he has his citizenship paperwork ?

If we do file now, is it possible to upgrade it once his citizenship oath has been taken ?

We do intent to file for the K-3 too, as and when he has his citizenship.

Hope someone can help us out here, many thanks.

Did they tell you how long it takes before he gets his citizenship? I don't know much about it, but I have heard that they can upgrade you once he is a citizen.

April/04/2005- Visa journey began!!

We did both K3 & CR1 visa's, got both!!- I returned to England for my CR1 interview after first arriving on a K3 visa!!

May/25th 2006- Green card arrives in the mail................YAY!!

19th June 2006 I Had to go to the Social Security Office to get my number, the DS-230 didnt work for me!!

26-June-2006- Social Security# arrived in the mail....YAY!!

Feb 2008 lift conditions <<<reminder to self!!<<<< went to England for a visit instead, no rush right, 90 days is a long time,LOL

Removing Conditions Begins

Mailed I-751 April 12th 2008

signed for @ NSC April 16th

NOA date April 16th

Conditional GC expired May 5th 2008

Biometrics Detroit May 10th 2008

10 year Green card ordered August 20th 2008

Citizenship any time from feb 2009

what i did was have all paperwork ready on oath day and send it out the day my kids took their oath- Oath was sept 19 we sent same day- case approved oct 17 and my daughter in law got 3.5 packet jan 18th

so it still moved fast once you put it in

My understanding is that he must be a citizen when you file the papers, but then again maybe I am getting the CR1 and K3 confused. (Someone smart come in here and tell us!!).

I hope he can take the oath soon!

An LPR also can file I130 and on receipt of your naturalisation copy your case status can be updated as petition filed by USC.

Also then if you want you can proceed to K3

I think you can be a legal permant resident and file the I-130. Im not certain!

This must be a record -- a response to a thread that's over FIVE YEARS old.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
