How ever, you haven't submitted all the disposition for the criminal convictions you check off that you had. The letter form the departme of public safety clearly notes that the records of that deparment don't relfect if you have been arrested by any state, local or federal law enforcement agencies. Further that inquiry was based upon name check only and is not supported by a fingerprint comparison

I believe a fingerprint check may resolve the problem if all else fails.

He had live all his live in NY. We got the report from the whole county.

Some friends also mention the fingerprints. I've been looking all night and online where to get fingerprints taken and I went on to my fiance's town police department and it says this:

Can I get fingerprinted for non-criminal reasons?

Yes, the Police Department fingerprints residents for non-criminal

reasons. There is a charge for this service.

What I don't have clear is non-criminal reasons....??? Will this be fine to send with the RFE????

No, it won't.

Law enforcement officials perform fingerprint services for citizens and businesses for insurance bonding and the like. Not the same as criminal check.

Ok, I tried to call VSC but as I'm the petitioner they won't give any info to me. So I have to wait for Pat to call, he's as busy as hell at work right now having problems. Plus I just found out his car engine blew out friday night and it's not worth to buy a new one. I mean I don't understand he bought a new track on 2004 and it's garbage now....anyways, good things he has his van so in the meantime he can use that one.....Oh me God!!! too much things going on right now....I called me stupid lawyer, he didn't mention if he sent a letter explaining what happened to our other petition and why we filed again. He said to mail him a copy of the letter I got and I said can I just emailed it to you??? And he said no! By mail. I only need a fuckin advice and it is going to take two or three days to send it where he is!!!! And at the end of the conversation, I don't know if if we lost connection on the cell phone or if he hang up on me....But I'm not calling that stupid lawyer again! I told Pat to do it.

Find a new lawyer ASAP, if you were the US citizen you could probably handle this yourself, you do understand what needs to be done, but unfortunately they wont give you much info. and I imagine you're not in the US right now either that makes it even harder, and since your fiance is busy, you truly need a good lawyer to do this for you.

Don't waste your time sending any other stuff to this stupid lawyer, he obviously has no idea of what he did.. neither of what you need to do to get this solved. He only agravated the mistake you made when you first filed. I'd no longer rely on his advice after this!

Re-read bella& bill's post, he gave you great advice.

I only have the same advice most have already given you. Take action! Send explaination letter including all the backup with RFE. You have not been denied and you will get through this.

Mirla, I'm sorry this has turned out to be a mess and that you are trying to handle this on your own since your fiance is very busy at work. I wish I am knowledgeable in this area to give you soundly advice, but from everything that I've read there are many many great advices given by our fellow VJ members. I agree with everyone that you need to find a lawyer, not just any lawyer, but someone who is an expert in Immigration Law and/or Criminal Law. If you can find one that has very good track records in both of those fields then it will help you out a lot. I know it's hard to do, but you must not rush into this. Take the time to carefully provide them with exactly what they need. A very good lawyer will be able to dissect the RFE letter and narrow down to what exactly is needed. Please do not try to do this on your own. We're all here for you to support you in this time of need. Just remember to try and take care of your health as well. Stay positive!

I just read the thread. I am not an expert, but I do have some suggestions. You have to take everything in steps and you have to be extremely organized.

Step1: Fire your current lawyer

Step2: Please, please do not send any documents to USCIS without "new" legal representation

Step3: Retrieve all copies of your original application, the RFE, your response and all it's contents, and the denial letter.

A copy of your second application and the RFE letter.

Step4: You need to take all these things to a "new" reputable lawyer. Please get someone with at least 10 years

immigration law experience. You have to be careful about the type of lawyer that you take. Bring all the

documents to him/her. Give them the full version of the story and all the documents.

Here is your problem.....

How ever, you haven't submitted all the disposition for the criminal convictions you check off that you had. Therefore, the letter submitted doesn't establish that you checked off any of the boxes in error on questions 2 and 3 of page 3 on From I-129F...

1. You need to address the fact that you checked off the wrong boxes in a letter

2. You need to do a full criminal background check using fingerprints

Please if you can just relax, and do this step by step....I promise you that it will get you an approval!!!
