1. My fiance just had his passport-size photograph taken to include in the I-129F petition, and although we asked them not to re-touch the photo, it appears as if they might have done so. Will this be a problem? Should he have his picture taken again?

2. For the G-325A: Under "Applicant's employment last five years" - My fiance has been in school for the last five years. Should he include the Names of his schools/student occupation under this section or simply write "unemployed"?

On the photo, it would depend on what sort of retouching was done and how blatant it is. If its bothering you, yes go get another photo taken just to give yourself peace of mind.

On the employment history, yes, just put down 'unemployed' for the last five years to present. My husband had all kinds of crazy gaps in employment in the 5 years previous to filing, it was a nightmare trying to get it filled out correctly.

If you're concerned about the passport picture, I would get another one.

Student is preferrable to "unemployed", in my opinion. I would list the occupation as student and show the dates of attendance to each school.

Facts are cheap...knowing how to use them is precious...

When they say that they want a photo not retouched, that means is they want a photo that shows you exactly how you are. not digitally enhanced to remove wrinkles, darken your hair, thin your face to shed weight, change your hair from straight to curly, etc etc.

you can pretty much do anything to a photo with common software and they dont want you to manipulate the photo in any way to make yourself look better or different.

they dont mean not to touch your photo and leave fingerprints. though any marks that obscure the photo will be a no no as well.

Now some passport photo places will photoshop in a suit on your body or collar shirt etc to make it look more professional. That tends to be ok with government agencys as long as you dont do anything to the face.

What do you think about adding a date in the corner of when the picture was taken?

i have no idea. i wouldnt want a date on the ones i submitted, but i cant say that would make them bad either. if a date was to be on them it should be i think on the back of the photo not the picture side. All the pictures on the USCIS site, none of them have a date on it though.

Yes, I was referring to the photographer re-touching the photo. It's not obvious, but his skin does look a tad air-brushed if you look closely.

I agree with this. I don't know whether it would be a problem if you just put "none" or "not employed", but it will certainly answer the question (and avoid even potential misconceptions) if you put "student" or "None (full time student)" or something along those lines. That way you cover your bases no matter what.

Laura, if you are talking about the passport photo, no, don't put a date on the photo itself (I'm not even sure you can). My fiance's had the date stamped on the back of it. He went to the main government building in Edmonton which I guess has some kind of office that will provide passport photos to comply with any country's passport requirements (???). Mine doesn't have that. There is a requirement that the passport photos be taken within 30 days before you submit the application, so it is probably nice to have that stamp with the date on the back, but not necessary.

If you are talking about the pictures of the two of you together, they do suggest having those pictures where the date is added by your camera. The thing is, though, that is easy to manipulate and pictures are only considered "secondary evidence" anyway, so I don't think it's really critical. Personally, I don't like the way those make my pictures look so I did not do it. We just labelled the pictures with the date and place they were taken and our names, that's all. The same photos go in my albums, so I want them to look nice, and we have plenty of "primary evidence" of boarding passes, so I wasn't going to mess them up! Others may have a different opinion on that, but I really think you can do whichever you prefer.
