In February she was here for 2 weeks then when she tried again in July it was denied, the guy didn't even look at her, he saw one piece of paper and said she didn't have enough proof she was coming back.

What do you see as different now? What transpired to cause the CBP officer to look at proof she would return?

Please help us help you.

If she's honest with the guy and say she's getting married, and wants to wait out the 6 months here with me while we plan our wedding and then fly back for the interview and then fly back here to get married, can he really say no to that?

Of course he can say no. We're trying to help you get an idea of the chances. Without the answers to the direct questions asked, I don't see how we can help you assess the risk any better than we already have. Please answer question two above.

Sure, the officer can say no! How does he know that she's telling the truth?

I don't know the answer to your second question, he just wanted proof.

I don't know the answer to your second question, he just wanted proof.

You need to find out. Why did the issue even come up. She was asked the purpose of her visit. What was her answer? What was his follow-up question that resulted in her showing him something? What did she show him?

It matters. It matters a lot. I wouldn't buy a ticket that could end up being wasted until I had a better idea why she was denied the last time and had a real plan to avoid it the next time.

I wouldn't count on showing proof of the pending case being a positive thing, particularly considering the recent denial of entry. They keep records.

My fiance was here from Germany on a visitor visa when we filed our k1. We successfuly adjusted the length of stay twice, the third time we tried to extend his stay we were very honest. We told them that we wanted to stay together as long as possible while our K-1 was being processed and that he would be going back to Germany for the interview.

They denied our request this time stating that it was because we had a K-1 pending, saying that this implied that his stay in America was intended to be permanent and not just a visit, even though they knew he would have to go home for the interview.

I don't know...I don't think honesty always works! lol

Our time line:

06.10.05 - fell in love in Hawaii

06.14.06 - met his family in Germany

03.15.07 - engaged

04.31.07 - sent in 129f

06.05.07 - recieved by CSC

08.20.07 - called because NOA 1 never recieved

09.27.07 - NOA 1 recieved

10.03.07 - visa approved

10.06.07 - my fiance goes back to Germany

10.11.07 - NOA 2 recieved in mail

11.11.07 - going to see my love in Germany!!!

11.12.07 - packet one recieved in Germany (same day I arrive, woo hoo!)

11.13.07 - sent packet one back express one day delivery

11.23.07 - packet two arrived with interview date!! (day before I left, woo hoo!)

11.24.07 - so so sad, back home without my fiance

What if she shows proof of the pending case?

Even if she shows proof of the pending case, that doesn't offer proof that she intends to go back to her home country at the end of her visit. A filed I-129F doesn't necessarily translate into a return flight home - it might in fact add more suspicion on her part than anything.

If your fiancee can't get enough solid proof to prove that she has intent to return home at the end of her trip, then it'll be a wasted plane ticket. Usually people bring proof of a return ticket home, rental agreement papers, or letters from your fiancee's employers stating that she's returning back to work at the end of her trip. Even then, that kind of proof might not be enough.

It's not impossible to visit - with a denial under her belt though, chances are that your fiancee isn't going to get in with just an impending I-129F as proof.

Yes, but the immigrations officers are trained to be suspicious. If they think she is going to stay they won't let her in, as happened last time she tried to visit you. The burden of proof is upon her to convince them of her strong ties to her home country, which they didn't believe last time. Its very unlikely they'll belive her this time.

Trust me, we all know how much is stinks to be apart. We all want to be able to wait out the visa journey together. But I really think if you look at this objectively, you will come to realize that her buying a plane ticket and flying to the US will be a waste of money and time.

Doesn't look good. I was hoping your answers would give a reason for hope but even that was wishful thinking. In the absense of any further reason for optimism, I'd say, yes you'd be crazy to spend the money on an airline ticket for her. The odds are just too great, she'd be turned away again.

another thing i just thought of.. upon approval theyd be sending all the info to her for the interview like forms and stuff shed need to fill out and send back in. could get tricky in these last stages if she isnt at home to receive the stuff.

This is a pretty crazy, nutts, off the wall idea. And I dont want to sound negative, but your fiance's chances of getting into the US is slim.

Its difficult to go the K-1 route because of the wait and process, but everyone has to do it. Yea, it would be nice for all our fiances to fly over and help us prepare for the wedding right?

All of us here want to be together with our fiances. Sigh...

Some even consider entering with a B-2 and just getting married while in the US (which is illegal, but many do get away with it). much easier than the K-1 Route. Not much paperwork, not much waiting time.. etc.

In any event, hope it works out for you.

As for me spending time with my fiance, I am going to fly over to see her the 4th time this year. I'd rather have her fly here on a B-2, but the chances are on getting that B-2 visa is nearly impossible. (since she has no travel history and have strong ties in returning)

I was denied entry at the border while driving down to spend some time with my now husband. That was before we had applied. I had evidence of returning within a few weeks, but due to the size of my suitcase, they made the decision to deny entry. And that was while I was with my fiance and his parents. I had crossed that same border dozens of time in the past. After that day, we got our paperwork in right away, jumped through all of the hoops and were finally scheduled for an interview on Jan 10th, 2005. I didn't want to spend new years without him, so we drove over the border to the US. They didn't even ask my name. Luck of the draw.
