Circumstance of Meeting

Hi everyone,

I am new to this forum and have read many good information here.

I just have a few quetions.

We met online and communicated with each other for a few years.

Then when we finally met in person we really hit it off and came really close.

I lived with her for 18 months and we decided to get married.

I came back home to file for the F-129 pettion so we can get married here in the US.

I finally received a NOA on 10/2007 after filing on 06/2007 and seems they are requesting for more evidence.

Unfortunately I lost my passport and cant show the arrival and departure stamps.

They want: Cicumstance of Meeting and Last Meeting evidence.

For circumstance of meeting, do I just write them a letter of how we met?

and for Last Meeting, I have an itinary of our trips together and receipt of my flight to Thailand.

We have photos of us together but none are dated.

Will this be enough?

Will this be enough?

A letter is sufficient to explain how you met. In the original packet you should have sent; 'A declaration of how you met in person in the last two years. This should be a single typed page attachment regarding question 18 of the I-129F. Make sure to sign and date it.' see the K1 visa guide here for details.

For last meeting evidence the itinerary and receipt will show you bought a return ticket to Thailand but not that you actually boarded the plane. In the absence of your passport you would be wise to try and find the following; boarding passes, baggage tags, credit card/bank statements showing transactions in Thailand, hotel bills, receipts. Anything that places you in Thailand during that time.

It's preferable to have dated photos but I wasn't able to provide them. Just send a few good photos of the two of you together. If any of them show you together at any landmarks then all the better.

Thank you for the great information.

I lost all my bording passes, good thing I used my Bank Debit card while I was down there.

I think I can print out my bank statents for the time of my travel and show the dates of my withdraws.

and one more question.

I have a photo printer. Can I add dates on the pitures and print it out?

I personally wouldn't. I think USCIS are aware that dates can be manipulated. It probably makes no difference either way but I would just send the photos as they are.

I think I agree with you. I will just print out a few pictures and send them in.. will just add some notes in the back and cross my fingers.. hope everything I send in willbe ok..

I agree. Missing passport stams is not very good, BUT, I do not think that it is must. Well, I saw my fiance September 2006, and it could be possible for me to loose my passport if I did not know I need them for applying K1 visa. Fortunately, I got 10 year passport and kept new one and old one. I was about to throw my old one away, but I wanted it as my memory, so I kept it. It helped me bc I needed to show my passport stams as a primary evidence.

Sending credit card transaction, photos, and honestly explained that you lost your passport, they should understand. My fiance even put a wrong date on one photo and we are freaking out right now about this mistake.The correct date was on the back of the picture, but he thought that it was the number of the photo file and he tried his best to remeber the photo which was taken almost a year ago. Since then, we have been in a long distance relationship, so this is the latest photos we sent. He came to visit me 2 months ago, but we sent our package in July, so of course we did not include 2007 pictures.

Did you get any info from USCIS? Please update your situation. Hope that you two get together soon :dance:

I think what you sent was enough. About dates of photos, I have different opinions. I think that it is good to add dates on photos. Say, some couples have been together for more than 2 years. And if they are together for 4 years, but long distance is 2 years, USCIS will deny the case because couples must met each other within two years. So passport stamps show that couples met each other but more than 2 years ago and sent photos without dates, USCIS will believe that they met each other and took pictures, BUT, they did not meet each other within 2 years. I know that degital camera usually do not show dates unless you set. My degital camera had the same problem, but he got dates based on the dates of picture folders. So simply sending photos without dates won't prove primary evidence enough. Anyways, Bank Statements of my ATM withdraws in Thailand can substitute as primary evidence. It is a bank statement, and pretty solid.

I agree with you sunshinegirl but seems it is not enough for now.. I just checked the online status from USCIS and seems they are sending me another request for evidence. I hope that I will have what they request for. I guess will wait to see when I get the letter. Any ways I will be traveling to see my fiance this January. This time I think I will save more evidence.. but I am keeping my fingers crossed and hope for the best.

for regular pics taken with a disposable cam, I couldn't write the dates they were taken on the back? Thought I was supposed to and stuff or just not write anything because they wont believe it anyways?

Unfortunatly I didnt save any boarding passes. I threw them all away after I got off the plane. When I stayed at the hotels my Ficance did the booking under her name. I do have pictures of us together.

Today I just recieved another circumstance of meeting request.

I am just getting frustrated. I guess.. when I stated that I met my fiance online and traveled to meet her in person was not enough. I will try to rephrase my letter and re-submit what other info I have left. I already sent them my airline receipts and dont have any copies of it. I am pretty sure they still have what I sent on files still. I will send more pictures of us together. I will be traveling to meet my fiance agian and maybe I can gather more evidence and send it from Thailand. I hope this will pass soon.

You're leaving next month to visit your fiance? You must have found your passport then, right? Or you had to get a new one?

You can write the dates and location on the back of the pictures that you sent.

You don't have anything showing you lived together in Thailand?

Forgive me but you still seem to be in a bit of denial here. You've made it very difficult on yourself by losing your passport and throwing away primary evidence of meeting within the past two years. Now is the time to focus.

Just exactly what does this new request say? While you're at it, what did the first one say. Don't paraphrase or interpret. Post it verbatim and maybe we can better help you.

You're going to have to go into some more detail about how you met and how and when you traveled and then find some way to show evidence you actually traveled on those dates. Reconstruct what you can and give as many details as you can.

Another trip won't help you get your petition approved unless it is denyed and you re-file using the evidence of the next trip.

Facts are cheap...knowing how to use them is precious...

ok, you lived with her for 18 months and you have nothing to show in both your names? nothing to show for your time there aside from your bank statements which by the way only show someone withdrew money from your account. that could be yoru fiancee. not you. so that doesnt prove you were there. you are in serious trouble here proving you went there since you lost your passport with the visa stamps AND threw away the boarding passes etc.

photos are secondary proof, and you writing a letter isnt proof either. you seem to be paraphrasing alot and your paperwork needs to be VERY detailed to USCIS. if they ask you how you met, you tell the the website, when it was, if it was a paid site, Imbra site etc. i think you are going to be denied and you will have to go again on a trip and this time save everything. all your plane boarding passes, your hotel receipts showing BOTH your names, take pictures together in front of things with a date on it like a currency exchange board etc. And dont lose your passport. that is really hurting your case.
