Sending I-129 Form before receiving the I130 Receipt? (Vermont Center)

[Japanlover: No need to wait for that NOA1 for I-130. Read the instructions I posted earlier in this thread. You will definitely be okay.

Sahil908 followed the instructions and received their NOA1 for I-129f already. I received mine in 2 days. If you want to go with the I-129f and you don't care about getting that processed faster and spending the extra money, then go for it. It looks like it is going to be quite some time before you received the NOA1 for the I-130 so I wouldn't hold out hope anytime soon.

Man oh man, is this what I was needing to know! I'm going to get the packet together in the next two days!!!

Well, i got anoyed waiting for NOA 1 for my previous I-130. so i sent both applications I-129 and I-130 this time with another check on October 29th and suprise i got a NOA 1 for my I-129F application today . I am glad i decided not to wait for the I-130 NOA1 and that finaly the I-129F is on track. I wish i have done it a little earlier :)

I think people who are still waiting for their I130 NOA1 to file I129F should know about this. I would be more than happy to help anyone in a similar situation.

hi there sahil thanks for the information... im just wondering when did u file your I-130 applications? i filed mine october 29th and they recieved my I-130 application the next day... till now i dont get any NOA1 for my I-130 is theres any chance for me to sent the i-129f for k3 visa for my husband? by the way i use money order from western union.. and i forgot to copy the check that i send with my I-130 application but, i have the pay stub of the money order. and which is i can send the photo copy of it... and i still have the reciept number from the post office and the confirmation that my i-130 is already been recieved by them in USCS California

im about thinking sending the I-129f application tom but, im not sure if i will go and do this. i really need an advice from you guyz. does the pay stub with the confirmation copy will be ok? as i said i didnt get a chance to copy the check that i send with my I-130 please help me...

im always checking over the phone if my check is been cashed almost everyday but still not been cash =(

Okay, here's what you need to do. If you filed your I-130 at Vermont and you will file your I-129f at Vermont also -- same service center for both applications, the rules state to send in "evidence" of having filed I-130. I sent in a copy of our return receipt (green card) from post office and a copy of the check that we sent with I-130 (doesn't have to be cancelled check) with a letter stating that we are sending in these documents as "evidence" because our check has not been cancelled and we haven't received our NOA1 for the I-130.

We filed the I-129f on September 13, it was received by them on September 16, we received our NOA1 on September 18 and it states "pursuant to your request, we have waived the fee."

So we are now almost 3 months ahead of the game since we are still waiting for the NOA1 for the I-130 which was received by them on August 15.

For those of you who question this technique, go back and read the rules. The only time they say to send in the 797 (Notice of Action) is where they talk about the mailing address for the I-129f or the address on the 797. It does not say that the "evidence" has to be the NOA1 from the I-130.

I am glad you received your NOA1 for 129F, but I called USCIS to confirm if I can do this and they said although I will get NOA1 for 129F I might have two cases open and she recommended against it and asked me to wait instead. Again, I am not an expert I am not really sure who is right and what is faster, but I figured I should share this since I called USCIS with same exact question. I am going to wait I feel like I am almost there why mess up now.

Hi shaman, You do not need a copy of the check you mailed. You can send in your I-129F with copy of I-130 and copy of mail reciept that you received from the post office. Prepare a cover letter similar to the following:

To Whom It May Concern:

Please find attached an I-129F Petition for Alien Fiance(e) for my husband, xxxx, who is a citizen of Guatemala. This application is being filed for a K-3 visa. I have already filed an I-130 for my husband, currently pending in USCIS, Vermont Service Center.

Listed below are the contents of the entire package in order from front to back:

1. I-129F Petition for Alien Fiance(e)

2. Copy of Filed I-130 Petition for Alien Relative (Original Received by USCIS on 8/15/2007)

3. Evidence of Filing I-130 Petition – Certified Mail Return Receipt -- No NOA1 received as of 9/13/2007 – Per USCIS phone call, certified mail return receipt is okay to send as evidence of having filed I-130 Petition

Hi,

we sent the I-129F and I-130 at the same time and the wrong address too. After that we heard what we did was wrong.

But the good news was that we received our NOA1 for both of them. Actually, my wife went to San Francisco(CIS Office) and talked

to them where we did wrong! And they sent a letter to the USCIS (CA).

We are fine now. Thanks God!

Well yeah you can send I-130 and I-129F together. This thread is mainly for the people who sent in I-130 and are waiting for NOA1 for I130 to send in I129F.

You do not have to send in a complete package of the I-130 with the I-129f -- only a copy of the I-130 petition. I only did this as a courtesy. The important thing to send in is the "proof" that you have filed the I-130 and if you don't have the NOA1, then the next best thing as proof would be a copy of the receipt from the post office, UPS, FedEx, etc. showing that you filed it.

I want to mention one other thing: This is a warning: This will probably ONLY work if you filed your I-130 at the same address where you are filing your I-129f. If you filed your I-130 at Nebraska or Texas and they have transferred your I-130 to a different service center because they are not processing them any more, then I would not take the chance. You will probably have your I-129f lost and never catch up with your I-130.

With our application, both were filed at Vermont and they have now put both applications together.

by the way guyz i have a friend who is on the same situation as me.... she filed her I-129f without the noa1 for 1-130... and she forgot to do her letter stating that rahil's sample cover letter
