Hi everyone well we got bad news. I sent my AOS paperwork july 27th well i'm not sure where it went but it wasn't received till aug 7th so the rejection letter states that i need to send in the 950.00 and reapply.They did send the money order back so i have to go cash it.Well at least i received my EAD card. Good luck to all hope noone else gets that letter

If your petition was postmarked before July 30 you should not have to pay the new rate.

If you receive a rejected petition or application on the basis of improper fees, please do the following:

1. Verify RECEIPT and POSTMARK date:

As a reminder, I-485s filed by "Aliens Whose Priority Dates Were Current Under the July Visa Bulletin" and their associated I-765s and I-131s were subject to the OLD fees until August 17. They must have been received by USCIS by August 17, 2007. Note that the NEW fees apply to I-140 petitions, even if filed concurrently with an I-485/I-765/I-131 packet. I-140 petitions concurrently filed with above I-485s were subject to the NEW fees effective July 30th.

All other applications or petitions are subject to the NEW FEES effective July 30th. These applications must be postmarked or entered into a courier service tracking system prior to July 30th for the old fees to apply.

2. If it appears to be an improvident rejection, resubmit the original application/petition to the Service Center with a brightly colored cover sheet along with proof of timely delivery/postmark stating:

ATTN: CRU SUPERVISOR - CASE IMPROPERLY REJECTED FOR FEES

Enclose a cover letter detailing what fees were enclosed and what date the case was postmarked and/or received.

Not counting the Biometrics fee. The total fee for AOS after July 30 is actually $1010

Did you mail it by express, certified or priority, etc? If so, track it online and see when it was exactly delivered. If it shows that it was delivered before July 30 or if you have a receipt when you mailed it out. I would give every best effort to correct this.

It could have been mailed on July 29, the POST MARK needed to be before July 30, NOT delivered before July 30. The POST MARK is applied at the time of sending NOT receiving.

If mailed priority, certified, the OP should have a receipt from the post office showing the POST MARK date.

I have a small question ... my Staples UPS receipt says:

Entry Date: 07/28/07

Ship Date: 07/30/07

and it was received 08/01/07. Is this proof enough that I sent it before the 30th?

We sent my AOS the 26th of July and the shipment date was 29th... it arrived the 30th... everything is moving along so far.

That's enough proof for you that your packet was postmarked the 28th.

No, it is not. Your package was shipped the 30th, not before the 30th. UPS is not the US Post Office, so their receipt is not a post mark. You'll need to submit again with the full fee of $1010. I suggest you use a personal check, if possible. You'll then know when it was cashed.

Had you use the USPS, instead of UPS, on the 28th, you would have a leg to stand on. As it is, you don't.

Part of the problem is that USCIS typically uses the received date and not the postmarked date.

But if it was late, that is a whole other issue.

Good catch! I did not notice the part of UPS. When mailing things to on part of the federal government (USCIS) it is best to use another part of the US government (USPS) to do it. USCIS website clearly stated POST MARKED before July 30, and the only way you would get a POST MARK is from the POST OFFICE.

Looks like you will be sending the package with the new fee. Also use the newer forms dated after July 30, no sence in them sending the package back again for not using the newer forms.
