My ficancee is planning on getting a tourist visa to come to the U.S. from Brasil.

How will that effect us filing for a K1 visa while she is here in the U.S. or do we file a different form.

We get married while she is here how does that effect everything.

I do not want to file the wrong forms, for th wrong status.

If we do get married while she is here will she be able to stay while during the process.

Yes sir that is correct. You would not have anything to worry about if she is already in the U.S, She could go ahead and file the I-485, after you marry her to adjust her status, along with your the I-130, petition for relative. Only thing they may give you problems with is if you already filed for the K-1, then they may think that you have committed Visa fraud. If She was on the B-1/B-2, when she married you if the I-129F is still pending.

YES she does, she is very clear about that.

Please note that entering the US on a tourist visa with intent to marry and stay in the US is immigration fraud. A tourist visa is for those who wish to visit the US then return to their home country.

You could still file for K1 and have a visit while it is in process, but make sure she returns to Brasil for the medical and interview.

Or, you could marry while here and once she is back in Brasil, file for a K3 spousal visa.

She will fly to Juaes and walk across the border, then she will be a protected class, an ileagal alien and due all the benefits that entails, they do not deport illegal aliens just the legal ones.

Many file the paperwork for a K-visa while visiting in the USA, it has no effect, the visitor just needs to return home to interview for the visa, and must not overstay the visitor's visa.

If you do marry while visiting, you wont be filing for a K-1 visa, you will be filing I-130 for a CR-1 visa and perhaps I-129F for the K-3. The CR-1 tends to take a little longer than K-3 to get, but has the benifit of being less expensive to get green-card, the CR-1 is a Green-Card Visa, the K-3 is not, the K-3 has the added step of adjustment of status ($1010).
