I am a Canadian and I just finished studying for two years in California. I didn't finish my degree, but I met my fiance down there. I have now moved back up to Canada, and we are planning to get married here in December of 2008. We then want to move down to DC because my fiance is going to grad school there, and I am hoping to be able to work ASAP. I'm really confused about which visa I need to apply for and how long they will take. Help!

P.S. Ideally, I would like to work down in DC for a few months before our wedding, then go back up to Canada for the wedding and straight back to DC. Would this be at all possible?

Thanks so much!

Cecilia

I would suggest you read the guide for K1...Click on Guides located at the top of your VisaJourney screen....search for K1(click K1), and follow the guide.((This would require you to get married here in the USA))

Generally your Fiance would file the petition here in USA, while your in your country...you wouldnt be able to travel to the USA during this process...you would have to wait until you recieve the K1 Visa, after that you can come to the USA and you have 90 days to marry your Fiance....once your married you have to adjust your status.

If you wish to marry in Canada you might look up K3 or Cr-1 Visa's...this would be a Spousal visa vs. Fiance visa.

Maybe you can find other Canadian's on VisaJourney to better help your specific case. Good Luck !

You can travel to the US while K-1 is in process, it just might get a little more difficult getting in.

To the OP, if you plan to legally marry in Canada, you cant use a K-1. However you can get married here, and then go to Canada and have a ceremonial wedding. If you do enter on a K-1, you will need to marry and apply for AOS to get an EAD (Allows you to work) and AP (Allows you to reenter the country will your status is pending)

K1 is for a fiance(e) and the marriage must occur in the US. The OP indicates they plan to marry in Canada, in December 2008. There would need to be a major change in plans for the K1 visa to be viable for them.

Reading the guides and familiarizing themselves with their options is the first step. Then either pick the option that fits the plans or change the plans to fit the visa option. The current plans are incompatible with the available visa options.

Facts are cheap...knowing how to use them is precious...
Understanding the big picture is priceless. Anonymous
