I got my I129F and I130 Approved same time.

i was confused which to pursue.

can i pursue both.

will there be extra charges for applying for both.. :innocent:

You may not have a real choice. If the I-129f goes to the NVC first, the I-130 will be put on hold. When that happens, the only way to get it put through to the NVC is to file a I-824 and pay $200 but it takes so long you might as well get the K3 and then adjust status.

US Immigration Timeline

-------------------------

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

the problem with K3's nowadays is the exorbitant fees for Adjustment of Status -- and seems the waiting times are getting to be pretty much the same. I say go with the I-130 - but that's me, running out of coffee ;)

Yeah, they could pay the $200 for the I-824, and then in the meantime get the K3 visa and then later go back to their original country for the CR1/IR1 interview instead of adjusting status.

Be careful advising people the wait times are the same, it depends on the consulate. If you originally chose K3, was the decision make because of a faster process?

Be careful advising people the wait times are the same, it depends on the consulate. If you originally chose K3, was the decision make because of a faster process?

Example of CR-1 and K-3 reaching the consulate at same time, in fact the K-3 interview was scheduled for a date AFTER the CR-1. (Manila is one of the slower Embassies)

Is there a difference is the appointment scheduling for the consulate between K3 and CR1?
Both visas are handled by the same unit at the consulate, the Immigrant Visa Unit.

Another advantage of the CR-1 over the K-3 is wait time after filing the AOS in the states. It can take months to years to get a green card from AOS from K-3, as apposed to getting green card the moment you arrive on a CR-1 visa, K-3 also needs to wait months to get EAD in order to get a job, a CR-1 holder has the green-card which allows work.

Lawyers LOVE pushing the K-3 for the added fees they can charge to file I-129F, and later to file I-485 and I-765 to adjust status and file for EAD.

At the Pakistan Consulate this is the case?

Because not all consulates are the same, it is specific to the consulate. In CDJ it is 9-12 months for an interview once the papers are received from NVC on a CR/IR1 but on K-3 it is only about 30 days from when they receive from NVC.

I am only saying check the specific consulate and don't assume they are all the same.

In my case USCIS approved CR1 & denied 129. I believe CR1 is much better because of resident status & green card timing. It is also cheaper in the end if I understand it correctly.

Action bt NVC as far as time is exactly the same as far as I know. At this time NVC has told me they are very busy & to expect 90 days to assign case numbers.

No, the NVC timeline for I-130 and I-129 cases as completely different. No similartity whatsoever.

The 90 days they told you has no bearing on reality. It is just a pat statement to cover them.

And again I am referring to the processing times once the CONSULATE receives the files from the NVC. This is were you may or may not have different processing times and it would be worth checking into if your goal is to get your spouse here as quickly as possible. If money is the issue then CR/IR1 is the way to save some money.

Definitely check with the embassy to see how long the process is with them on each visa. But for the MOST part, both visas are running at about a 1-2 month difference. The CR1 is less expensive and by far a much better visa than the K3.
