I am an Indian citizen living in the US for 6.5 yrs now. I am a widow. I have a son 19. I have a work-based greeen card in process.

I met a US citizen. We got engaged. He filed for a K1 visa. I could have just got married since I was already in the US but we wanted to get K2 and AOS my son before he aged out on my work-based petition. Now my interview date in Chennai India is 10th Sept.

My questions are:

1. If they ask me why I need K1/K2 what should I say?

2. Since I have lived in the US for 6.5 yrs but applying for K1 from Chennai, where should I get police certificates from. Before moving to US I lived in Bangalore for 14 years and in Chennai before that.

I'm not sure I understand the motivation for leaving the U.S. and getting the K2... In fact, I didn't think they would approve the I-129F if it indicates you are already in the U.S., but it sounds like they did nevertheless...

A U.S. citizen may file an I-130 petition for a stepson. So, both you and your 19-year-old son could adjust status in the U.S. on that basis just fine.

A U.S. citizen may file an I-130 petition for a stepson. So, both you and your 19-year-old son could adjust status in the U.S. on that basis just fine.

Sorry, I take that back; I failed to take into account that the marriage creating the stepchild relationship must have occurred before the child's 18th birthday, the reason an I-130 by the USC spouse could not support adjustment of the 19-year old son but a K2 adjustment would. You are doing the right thing.

But what about question #2? Her interview is on Sept 10 and she has not even requested the police reports from the several places where she has lived. How long will it take her to get them? Is a report form the US required?

Assuming that the requirements for India are the same as other countries, you need to have a police certificate for every country where you have lived for 6 months or more since the age of 16 excluding the US. In Colombia, the 6 month period is cumulative, i.e. 2 months per year for 3 years = 6 months and you need a police certificate.

Assuming that the requirements for India are the same as other countries, you need to have a police certificate for every country where you have lived for 6 months or more since the age of 16 excluding the US. People have said a police certificate from the U.S. is not necessary because the U.S. does its own criminal background check as part of the petition and visa processing. I think if she needs more police certificates than she has presented at the interview, they should give her a 221(g) slip until she gets them and submits them. I don't think the 19-year-old has as big of a problem, since he's been in the U.S. the whole time since age 16 it would appear, and they might give him a K2 even as they give the parent a 221(g), I don't know.

I have a similar problem because the parent beneficiary was born in USSR, but the place of birth is now Republic of Georgia and the place of residence is now Russian Federation... To complicate matters, Russia and Georgia are not very friendly with each other and the border is closed even to mail service, and further the former place of residence in Georgia is in a dangerous separatist-controlled region, and the police certificate is looking more and more unobtainable.

We are attempting two last methods to try to get a police certificate from Georgia: (1) Contacting the Georgian Consulate in Russia to get it from there, (2) Giving a letter to someone going to the Georgian capital of Tbilisi where the police certificates are supposed to be requested in person, authorizing them to obtain the police certificate on behalf of the parent.

If both methods fail, we will submit affidavits of the attempts made to get the police certificate from Georgia (where parent hasn't lived in over 30 years) and any supporting documentation. They should give an exemption as 'unobtainable' under those circumstances.
