Annatenna and LovelyTena! I am sorry about what happened, just hang on and don't let USCIS affect rest of your life! Try to stay positive and happy and love your families and life - despite whatever happens! Everything is gonna be alright!

LovelyTena, I was out of country for 8+11 months -that's exactly half of required 3 years, I still qualify cuz i paid taxes, had property and bank accounts and family ties in US, i am thinking to get a lawyer to go to interview with me if I find one that i can afford.

USCIS is very illogical place, and if you are truly eligible and legal, then you will prove yourself eventually right and get what you deserve, but in my case i want to bring my mother here, she has nobody in world except me, so I would be very disappointed and hurt if i had to reappeal for another half year or wait another 3 years to re-appply.

My PAST Timelines:

10/2004 - Conditional GC

08/2006 - 10/2007 - Lifting Conditions timeline

10/2007 - 6/26/2009 Citizenship, Los Angeles DO timeline

06/30/09 - delivered

07/06/09 - NOA date (rec'd - 07/10) #WAC 09xxx3, touched.

07/08/09 - check cashed, #WAC 09xxx2 (not online)

08/29/09 - APPROVED!!!

NVC

09/14/09 - NVC case # assigned, emails registered

09/17/09 - email AOS bill received and paid online, ds3032 received and returned

09/21/09 - AOS bill status "PAID", FedExed out AOS, 09/24/09 delivered to NVC

09/28/09 - AVR:AOS acknowledged

10/02/09 - 3032 was acknol. by NVC, paid IV Bill online

10/05/09 - emails: 1 pm -RFE for 3032, 3 pm - IV bill, 5 pm - status PAID

10/09/09 - ds230 delivered to NVC at 9am

10/14/09 - AVR: Checklist response was received

10/20/09 - login failed! - between 5 pm and 9 pm PST, at 5 pm it was still working

10/21/09 - case complete! (AVR updated after 10 pm) = total NVC 37 days

10/28/09 - interview date email came at 6.30 pm, no AVR changes yet

10/30/09 - AVR: "Case sent to embassy on Oct 29" = total 4 months from delivery of i130 to USCIS

11/02/09 - Medical

11/20/09 - Interview - PASSED!!!

11/28 - POE: LAX

Feliz, were you out of the country for 8 months and then 11 months? Anything beyond 6 mos at a time is considered abandonment of permanent residency and you will have to wait to recomplete a straight 3 years again with trips of less than 6 months.

I'm not happy, but guess I'll have to just accept more delay and move on, otherwise I'll drive myself insane.

11th august 2007 - Delivery Confirmation receipt received

17th september 2007 - Money Order (FINALLY!) cashed

9th november 2007 - NOA! (notification period given 180 days)

21th november 2007 - Biometrics appointment letter

18th december 2007 - Biometrics appointment in Baltimore, MD completed

29th march 2008 - FINALLY received letter with interview date!

8th may 2008 H 8:40 AM - Interview in Baltimore-APPROVED!

8th may 2008 H 3:00 pm (yes same day, crazy!) Oath Ceremony in Baltimore

24th may 2008 - US Passport application mailed off

6th june 2008 - US Passport received in the mail!!!

I am sorry about what happened to you! I would have been very upset if someone sent me away, but you know.. they are GOV agency so I guess they can do whatever. I still don't think its right for them to put you out another 10 weeks and let those who filed after us July filers interview and get oath taking first. Why do they bother giving us priority date if they are going to place us behinds other people who filed later? :bonk::protest:

My St. Paul office WASN'T busy at all when I was there. In fact there were only 3 other people interviewing that afternoon. I understand how it feels to have to wait... This N400 process is taking wayyyy too long for all of us. Just hang in there. I don't even know whats going to happen to my case. Good luck for the interview. I hope they will speed up the oath date for you after all the trouble they put you through. ^_^

Just closing the loop.

Wifey applied for US Passport at the local courthouse on 17 April. She was very frustrated because, although the check was cashed on 29 April, she still did not show up on the passport status page.

On Saturday we got a little package with her nice blue US passport.

I would also note that she had been worried that the passport folks would damage her naturalization certificate. They did not, although the mailman did bend the package to fit it in the mailbox. Nothing a few days in an encyclopedia won't fix.

Congratulations! That is wonderful news...nice way to end this whole journey. :dance:

All I know, is that the USCIS' Guide to Naturalization based on 3 years time as married to a USC, says that you need to have 3 years as an LPR without leaving the US for trips of 6 months or longer. Also, it states that you need to have 18 months of physical presence here in the US.

I hope for you it can happen...but $675 is a lot of money to risk on not being right.
