Ice Removes Criminal Alien Elvira Arellano

U.S. Immigration and Customs Enforcement announced today that a criminal fugitive alien who spent a year seeking to elude federal capture inside a Chicago church has been deported to Mexico following her arrest by ICE here yesterday afternoon.

"Identifying, arresting, and removing criminal aliens and immigration fugitives - aliens who have ignored court orders to leave the country - is one of ICE's top enforcement priorities, Just because the woman has gone public and made an issue of the fact that she is defying law doesn't mean the government doesn't have to do its job," said Ira Mehlman of the Federation for American Immigration Reform, which favors limits on immigration.

It is good to see enforcement although it s long over due!

All of the individuals who willingly entered the country illegally & Especially those who submit falso SS# or steal SS#'s to commit further crimes are considered by the USA Dept. of Homeland security & ICE as CRIMINAL Illegal Aliens. Children who are born on USA soil Are NOT Criminals or Illegal Aliens they are only victims of the circumstances their parents bring upon them by commiting federal crimes putting thier childrens future, in jepordy.

She is not fit to raise a child, teaching her son that defying the law and commiting federal crimes such as ID theft and criminal behavior is ok.

Illegal presence is a civil offense. Illegal presence AFTER the courts have entered into removal proceedings and set a departure date is a criminal offense.

The article itself states that criminal aliens are those who have ignored court orders to leave the country. Until that point, their presence is not criminal.

AND SHE IS A CRIMINAL ALIEN WHO IGNORED A COURT ORDER, SHE ALSO STOLE /Falsified SS # to Obtain ILLEGAL EMPLOYMENT.

WHAT IS with people who think they can ILLEGALLY cross the USA border with out consequences, what gives ANYONE the right to disobey the law and not pay the consequences of their actions.

You break they law you pay the price. Illegal is NOT legal, it is disobeying Federal Laws, it is willingly defying the Laws of the nation they are illegally entering.

Label it however you like she got what she deserved and Justice was carried out and LONG overdue. Now hopefully ICe will be given the resources to continue to enforcwe the laws of our nation, protect our country and & Secure the future thsoe who are legally present here.

I was responding to this statement that you made. This particular woman had ignored the results of her removal order, and yes, of course, at that point it turned into a criminal charge. But as I said before, simple illegal presence is not criminal.

There is a big distinction there.

And I'm not even going to touch your rant with a ten foot pole. I can only imagine how much better the world would be if we could harness the energy spent on people's zealous diatribes denouncing those illegal aliens into creating conditions in the world that would enable people to stay in their own countries rather than migrate to the US.

But then again, off-topic would be a lonely, quiet place if people were fighting for global social justice rather than going on and on about those illegals!

To clear things up, entering the country without inspection is a crime. Remaining here after you enter is a civil offense. Coming back after you are deported is a felony, remaining here after coming back after deportation is a crime.

Immigration law contains both civil and criminal provisions. The removal of aliens,

however severe its consequences, has been “consistently classified as a civil rather than

a criminal procedure” by the courts.1 On the other hand, the Immigration and Nationality

Act (INA) contains several provisions that are unambiguously penal in nature, subjecting

offenders to imprisonment and/or fine under Title 18 of the U.S. Code.

Certain immigration violations carry civil and criminal consequences. An alien who

enters or attempts to enter the United States without authorization is not only subject to

removal or exclusion but is also subject to criminal prosecution, with a first offense

subject to six months’ imprisonment (a misdemeanor) and any subsequent offense

punishable by up to two years’ incarceration (a felony).

In 2004, for example, the Border Patrol seized approximately 1.16 million aliens who

unlawfully entered or attempted to enter the United States from Mexico. Department of

Homeland Security, Office of Immigration Statistics, YEARBOOK OF IMMIGRATION STATISTICS:

2004 (2005), at Table 38. Only about 16,000 aliens (mostly serial offenders) were convicted of

the crime of unlawful entry. Id. at Table 50.

subject to six months’ imprisonment (a misdemeanor) and any subsequent offense

punishable by up to two years’ incarceration (a felony).2

Although an alien who unlawfully enters the United States is potentially subject to

removal and criminal prosecution, an alien found unlawfully present in the U.S. is

typically subject only to removal. Unlawful presence is only a criminal offense when an

alien is found in the United States after having been formally removed or after departing

the U.S. while a removal order was outstanding.3

The availability of both criminal sanctions and removal authority for immigration

violations does not mean that both tools will be used concomitantly, especially if one tool

can more easily be employed than the other. The vast majority of aliens apprehended by

the Border Patrol unlawfully entering the United States are either removed or (far more

often) permitted to voluntarily depart in lieu of removal without being criminally

prosecuted.4 This is largely because pursuing criminal charges in all cases would place a

heavy burden upon prosecutorial resources and detention facilities. Unlawful entry

prosecutions of aliens found in the interior of the U.S. are even rarer. Such cases are

difficult to prove, as the government must present affirmative evidence that an alien

unlawfully entered the U.S. It cannot base its case solely upon the inference that the

accused’s unauthorized presence in the U.S. was likely due to him unlawfully entering the

country;5 an inference that might not always be accurate (e.g., with respect to a lawfully

admitted alien who overstays his visa).
