I'm still several months from this stage but I'm a bit anxious about this segment of the email when you receive instructions at the NVC stage. I always knew they did question if you'll become a public charge but I thought it was mostly based on your sponsor being able to meet the financial requirements? I'd be able to even get a joint sponsor that comfortably meets the requirements if needed. Most people I've asked said this part is new so I'm scared my K1 will be rejected.

 

I'm from the UK and I recently finished studying so I've been unemployed for a few years and since I had savings and K1 in the process, I haven't been working since I didn't see the point of working for several months just to quit to move abroad. I've got a university qualification, a college degree, work experience and things like that and I'm going to ideally search for jobs relevant to my college degree when I'm there but I'll search for anything if we begin to struggle with money. I'd be living with my partner so we're okay with accommodation. They don't have health insurance though so they wouldn't be able to put me on any plan, I'd have to pay for that myself out of my own money using travel visitor insurance or something. Will the consuale officer be likely to reject me on public charge ground? Should I look for work in the UK immediately?

 

Does anyone have any advice or insight into this? Thank you.

Just for the purpose of clarity, are you the American petitioner sponsoring your fiancé?  I believe it's the other way around, but just checking. 

 

If you are physically together or visiting soon, why not consider a CR-1?  

 

Regardless, if you are the American and are living abroad, you'll need a joint sponsor because you don't have US income If it's the other way around - you're the recipient of the K-1, then it's up to your partner, not you, to prove to the US government that they generate sufficient income to cover your expenses.  If they do not make enough money, they will have to find the joint sponsor.  

 

Edit to add: you cannot work in the US until you're married, have applied to adjust status and have received work authorization.  If you opt for a CR-1, you will enter the US with a conditional greencard, will be eligible to work and won't have to wait.

I'm the beneficiary who's still in the UK. We received NOA1 for K1 about two months ago now. I know that the NVC stage is a while away but I was just worried because I've seen a few people say that having the option to send a public charge statement is new. I've read the images I attached back since I posted this and I think I might not have comprehended it properly. I've just realised that it says that it's voluntary and that the topics are things they *may* ask you at the interview, not that it's required to address every single question there with the public charge statement.

Your US fiancé is sponsoring you financially. So does that fiancé meet the financial requirements and have they the evidence to prove it? As for health insurance, I cannot stress enough it is very important for your fiancé to obtain their own health insurance and when you are married, add you to that insurance. You will be unable to work for quite some time in the US, so your options will be limited until then.

My fiance meets the requirements and they have the evidence, yes. They don't have an insurance plan that they can add me to though. If they don't have one to add me to by then I'm not sure if visitor insurance would be enough.

There might be UK Travel Insurance that covers one way trips, but it certainly would not be normal.

 

If you had serious medical or maybe even not so serious medical issues the forst thing an Insurer would be looking to do is repatriate you.

Even if it's just for a few months, you might want to work in the UK while you can.  Savings go by fast with all the immigration related expenses. 

Health insurance will be expensive (depending on your location it can varies quite a bit, but expect at least a few hundred dollars per month, it can also be much more). 

 

Alternatively, your fiancé could find insurance (on his own, or through an employer), and add you as soon as you're married.
