My fiancee had criminal records.. he had weeds related case when he's in teenage before..because that time it was illegal..but now today it's legal now in their,and he have child neglect case,because their parents house is messy.. he just receive the email says guilty and ,said that u should clean the house and they let his kid stay with him.. he never been in jail

  Is there still a chance that we approved in K1-VISA ?

 

Btw my fiancee is from Chicago Illinois

I would marry and file for a spousal visa.

Note:  Possession of weed is still a violation of federal law. 

 

It is EXTREMELY important that he discloses all arrests and criminal records.  Failure to do so could lead to a denial.....  Good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

But must be disclosed with the I-129f package.  I know of one case which was denied because the petitioner failed to disclose an arrest. It was discovered during DOS criminal background checks.  Sadly, it resulted in a denial after the consulate interview.

Not only must he disclose the offenses in the I-129F petition he must include copies of his court dispositions with all the other evidence he sends or he will likely get an RFE which will delay the case. Also, you need to be prepared to talk about it during the embassy interview because they may ask you about it to see if you are aware AND you need to be prepared to talk about it during the CFO because they are mandating FBI criminal background reports of almost all US Citizen Petitioners of K-1 Visa Holders now. I believe the one you should prepare for the most is the CFO questions because the embassy's consular officer is going to basically just make sure you are aware of the charges. The CFO counselor is going to ask you a lot more questions about it. So get comfortable discussing it.

The best advice about the CFO that Jaycel said she got. from here on VJ by the way (thank you VJ Family!), was to bring all of the evidence of your relationship that you sent to USCIS and brought to the embassy and be very familiar with it because they will go through it all and ask you questions about it. Be honest with the counselor and pay attention to the seminar part because they will ask you questions to see if you were paying attention. Most important, be polite but FIRM with the counselor that you are 100% confident in your fiancé, that you know him and love him and that you are ready to begin your life with him in the US. Be confident in your relationship because it will show the counselor that they can issue the certificate without worry.
