Hi everybody,

I hope somebody has an answer to my problem. I was approved a K1 visa but had to go out of USA because of a private reasons and now I am applying for the K1 visa for the second time.

Is there any way my fiance could speed op the process since the government must have all our data someplace already.

Thanks !

Not the case if the K1 is being filed for the same person as the first K-1.

Did you use the A Number from the first K-1 on the new I-129F, and G-325A forms? That may help them look up the previous case.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Is now a US Citizen immigration completed Jan 12, 2012.

You start from scratch but your fiance must add a letter explaining the circumstances and asking for a waiver. More about that is available in the IMBRA topics forum.

No, it is unlikely to be processed any faster because you were previously approved.

Second chances are allowed, even with a different fiance(e) within two years but require a letter requesting a waiver.

Thank you all for posting replies.

We are just applying for the visa for the second time so we haven˙t filled in the forms yet. Where on the form should we use A Number?

On the form itself it says that it is a field for USCIS use only.

It is for the same fiancee. Do we need a letter requesting a waiver?

I would if I were you take a second look at the G-325A as well as the I-129F Part B, Q#9

If you read the IMBRA law it appears that you do not. There is some question as to whether the USCIS is adjudicating properly.

My reading is similar. I would say you need the waiver letter because USCIS is not adjudicating as the law is written.

In my case, I filed for a second time for the same beneficiary within a 2 year period , and requested a waiver if needed. As it turns out, we were approved in 80 days, no problems whatsoever. I just was making sure to cover my hind end because I was not certain how USCIS would interpret the IMBRA law.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.
