Hi I am adjustment through my spouse us citizen.

he made less than 9k for the past 3 years for 2022,2023,2024 and didnt file tax.

I have found the joint sponsor with 1 dependent who make 42k for 2024 tax year and make 45k for 2025 year.

But 2022 and 2023 she made 24k per year.

 

i was assured by my lawyer and actually multiple lawyers I have consultation that I can use my joint sponsor with only current 2024 years tax return and 3 month paystub 

 

as for my husband he did not file tax and we just submit letter state that he didn't file because of that.

 

Now we got rfe notice that I don't know what it is about but my lawyer said might be finance - 

My question is is it true that I can use this joint sponsor eventhough 2022 and 2023 income is not enough? do I need to switch joint sponsor to someone else?

is it because my husband non file tax?
should I file tax for my husband  for 2022,2023,2024 even though he didn't make enough

The lawyers are right 👍 

The most most important is the 2024 tax return.

The last three paycheck will just confirm that the sponsor is currently working.

But why are we getting rfe for it then? Is it because my husband petitioner didn't file tax? 
I know I have a lawyer but I felt like a lot do stuff I have to catch on the mistake he made. 
so I am worried about the rfe

I understand you.

Some lawyers are terrible 😔 

Just respond to the RFE or look for another person with a better tax records as I did.

You said you don’t know what the RFE is about yet? So it may be nothing to do with finances anyway. All you can do is wait for it to arrive and then address it.

The RFE could be for anything. It could be finances, it could be relationship evidence, or maybe you used the wrong version of the form or forgot to complete a question or forgot to sign. Relax, and wait for the RFE to arrive. There is nothing you can do until then.

Received rfe said that sponsor are not qualified as well as joint sponsor.

My sponsor have not file tax so we have him filled out affiadavit that he didn't make enough income and has not file tax in the past 3 years.

my joint sponsor single with 1 dependant make 42,221 for tax in 2024 and 52 in 2024

we submit tax script for 2024 and 3 month paystubs for 2025

however for 2022 and 2023 she made 22k we did not submit documents only add number on forms. 

 

I have another attorney take a look and they said 

my joint sponsor is qualifed 

but on the form i864 there's box leave blank and unchecked.

and he only sent 1 page of tax transcript not all pages.

 

----- And we can submitted the same joint sponsor but correct those mistake.

anybody experience this?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
