To make a long story short I was let go from my job during the summer, it was well-paying and allowed us to live off savings until I got my new job which starts tomorrow.

 

We received the notice of action telling us to go to the Immigration Services next month and if requested, show the last 2 months of paystubs. I don't have that unfortunately as I was unemployed for half a year.

 

Her brother is here in America and is a green card holder and does very well financially. Could he file the form in replace of me? I will make enough to support us again but I am worried my recent unemployment could mess things up.

No. You must need the principal

 sponsor but as a GC holder he can be a joint sponsor   Have him complete the forms c and documentation and Take all that  to the AOS interview. Officer will make the decision that the joint sponsor is or is not needed.
