Hello,

 

My now husband came here on a K1 visa in October 2024.  We filed i765 work permit and i486 adjustment of status together in December 2024.  In January 2025 he did biometrics and ever since we have been waiting.  The i765 said "Fingerprints taken" the entire time and a few months ago i485 changed to "ready to be scheduled for an interview".  After waiting a few months, I ended up filing for an expedite for i765 due to financial hardship and today the i765 case says "Denied".  A few questions..

 

1)Does this mean the entire i765 was denied or just the expedite? I did not get the notice in the mail yet but I am concerned the whole thing is denied since it does not specify.  

2) Is there a common reason that this would be denied while the i485 is still pending?

 

Please help, thank you!

It could be denied if you filed it under the wrong category... Do you remember if you filed under category C 09?

Yes I did file under C09.  If it was filed incorrectly, wouldn't they have sent me a notice months ago?

Not necessarily... it all depends when an adjudicator gets around to looking at it. The filing category was the only thing I can think of off the top of my head. From the status updates you describe, I'm going to assume your receipt numbers start with MSC and not IOE correct? It's possible the denial is just your expedite request but there's really no way of knowing for sure until you get the notice in the mail.

Yes MSC receipt number.  I thought the same too however when I was reading it said the notice would specify that it was denied for the expedite.  Thank you for your help

There's no form i486, maybe I-485?

That's what I meant i485 sorry.  That's what I am thinking that the actual i765 is denied and not the expedite.  Is there a reason that would be denied after waiting for 10 months and the i485 is still pending waiting for the interview date? Thank you for your help

Without having the letter we can only speculate at this point. 

Could be the expedite, because the original is about to be approved. Could be both of them since the "system" finds you too close to an interview for the I-485. 

Could be you had an error in the application or even them hitting the wrong buttons.

Thank you for this information, do you think if we call they can give some more information on the phone as to why it was denied?

Sure,

Tier one people have the exact same info in front of them as you can get using the online accounts. They just give you the same information with some additional wording trying to make it sound more official. Tier two has slightly more info but good luck trying to get a hold of one of them. I have found the phone system to be an excellent option for scheduling appointments and that's it.

Wait for the letter. That is your starting point.

Please keep us updated.  I would like to know why they denied the EAD.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
