Hello All,

 

I am petitioner and i am trying to withdraw an application ( NVC ) and they are giving me hard time. There is nothing on the website that say i need to submit a divorce,  only a writing statement wish i did. But they always reply to me that i need to submit a translated divorce! After that they asked me to log in and go to https://nvc.state.gov/ceac select the Remove Applicant button. I don't see that option! But as i said,  there is no roles saying i should submit any documents to withdraw my application! Actually you can ask to withdraw even if you are not divorced yet! Any help? Should i sue them for refusing to withdraw the application that i submitted and paid for? I am getting married in two weeks and i need to submit for my wife. Please see attached.

You are the petitioner.  Have you withdrawn the case at USCIS?  If so, tell NVC that your I-130 has been withdrawn at USCIS.  If not, contact USCIS and withdraw the I-130.

 

Please note that, as the petitioner, you have submitted a petition, not a visa application.  The beneficiary submits a visa application.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yes i paid some fees and submitted some docs at the NVC but not the financial docs, so case still at NVC for over a year now.

Please note that, as the petitioner, you have submitted a petition, not a visa application.  The beneficiary submits a visa application.

Also, i just logged in to USCIS  and the case is already closed long time ago, it does close automatically when it's transferred to NVC

An approved I-130 is the basis for an NVC case.  If you withdraw the I-130 at USCIS, there is no longer a basis for a visa application.  In addition, if you have not submitted any financial documents, the case will die at NVC.

I would contact USCIS and withdraw the I-130 petition.

What does this mean?  What, exactly, are you trying to withdraw? Are you marrying a different person?  If you are already divorced, just send them a copy of the divorce decree......by sending the divorce decree, you are showing a clear paper trail as to why the case is void.

The approved I-130 is no longer valid as the OP has divorced, and the relationship no longer exists.  I would explain that to USCIS, NVC, and the consulate.

Short story, i am the petitioner and i want to withdraw an application at NVC, but they are asking me for a divorce decree... the website doesn't mention submitting any proff to withdraw an application, only a writing statement. But they are insisting to submit a divorce decree...  i know you can withdraw an application divorced or not divorced, its your right. But not sure why they want a proof! I am the petitioner and i want it withdrawn.

But if you have the divorce documents, just submit them?

Sometimes the path of least resistance is the best course of action....even when you are right...  That's one bit of wisdom I have gained over the last 72 years...LOL.
