My wife got a notarized document saying that she has custody of older daughter at gong zheng chu in China.

 

Here's the issue, on I-130 I only filled out 1 divorce for previous marriage which was on 2016 Feb, 19.

The notarized document above(custody paper) states that my wife was married to her previous spouse on 2010 Aug, 26 then divorced at 2016 Feb, 19.

 

The reality is that my wife was married on 2010 Aug, 26 and divorced on 2013 Jul, 17. Then She remarried the same person on 2016, Feb, 18th, divorced on 2016 Feb, 19th. They did this because the younger daughter needed to be on a family book.

 

I am now filling out DS 260 and it asks for all previous marriages and divorces. Should I fill out the gap in 2 divorces or leave it as 1?  The notarized document for custody does not show the gap, I assume this custody notarized paper will be needed for interview.

 

 

Please help, I'm completely lost when I found out about this.

I-130 already asked this question. If asked why only listed 1 divorce on I-130 then asked again about DS260, should I tell them I didn't know? I am the one who filled out everything.

Explain what happened to them...

Her I-751 (if applies) and N-400 will ask about marriages again, so you want to have accurate info.

You gave the initial information in good faith.  You're correcting it in similar fashion.  USCIS, NVC, and the consulates thrive on the truth.  When asked, explain just as you've explained it to us; even better, be proactive about volunteering the clarification.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Adding to what @TBoneTX said about thriving on truth: the advice given to people going through the security clearance process is that the people who investigate and adjudicate are able to tell the difference between not understanding a question on a massive form and an intentional lie or omission because they’ve reviewed thousands of these and can tell the difference. Said more bluntly: no one’s as special as they think, including with stuff like that.

 

Same is true of consular officers reviewing your case. They’ve done plenty of these. They know the difference between an honest mistake and a lie because you’re likely not the first person to have made the mistake who they’ve processed.

All previous marriages and divorces must be documented.  "I didn't know" is the truth, but in reality, you didn't know because you weren't told.  Maybe you didn't ask the right question. Maybe this information was concealed from you purposefully.  WHY you  didn't know needs to be part of your explanation, and certainly part of her explanation at interview.

Facts are cheap...knowing how to use them is precious...
