I spoke to her today, she said she paid a fee to be seen at the embassy to renew her green card and was given appointment within 2 weeks. I wasn't aware and just heard the story of the embassy not renewing her green card. She said she paid for immigrant visa appointment. 

If she is pursuing the SB-1, she needs to research that process very well.  As others have said, these visas tend to be very rare, and grudgingly issued, so she needs to make sure she has the evidence of her need to stay outside the US for so long.

In my opinion, she should have just gotten on a plane and returned to the US.  She is authorized to board a plane with an expired 10 year card.  The worst case would have been to argue her case in immigration court.....or she could have been admitted with NO court appearance.  Is her appointment in Lagos?  That is the WORST consulate in the world to argue a case, imo.  They are tough, and they could easily deny her case.  SB-1s are not given easily anywhere.  Then what is she going to do?

Yes, she said her appointment was in Lagos and was surprised how fast she was able to secure a date. I bet @ being the worst consulate in the world. She mentioned that there weren't a lot of applicants like back in the days. I told her probably cos student visas aren't being issued at this time.

 

Well@ what she is going to do. She doesn't know much about immigration and kind of giving up. Except I do something like you had mentioned "hop on a plane" but it's summertime and tickets aren't cheap.

To be fair Lagos deals with the hardest cases

She already pursued it last month. Can it be pursued multiple times? 

Best bet, if she flies in and no major issues at port of entry and recommended to appear before a judge. We can work that out together by being her interpreter and representative.

OK, now I am confused.  You mentioned she has an appointment with the consulate to renew her GC.  Consulates do not renew GC to the best of my knowledge, so I assumed the appointment was for an SB1 visa.  Not really sure now what has gone on or will be going on.

I don't know the type of appointment she went for. I wasn't aware of her plans to go to the embassy, but she went and was denied. When I spoke to her few days ago, I asked her how she was able to be seen cos I didn't know GC holders can apply for visas when they are already resident. She mentioned "immigrant visa" was what they applied for her. Who are the "they", I don't know.

Sorry for the confusion. I have never heard of SB1 visa before until you mentioned it and I had to google it. All i was aware of about GC is that you can renew them as long as you want. I never knew holders can apply for any other type of visa. I'm learning from this thread.

The Consulate have reviewed the case and have taken a view

I think she might be given a notice to appear for immigration court. I'm not sure they would detain her.  No one really knows what will happen.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The problem is we don’t know what she’s had denied. Was she not given any kind of paperwork or denial notice?
 

She isn’t likely to be allowed to board a plane with an expired GC, the airline won’t accept her. Was it maybe a boarding foil she applied for? That would make more sense, it certainly wasn’t an immigrant visa. 
 

I think you need to work out exactly what she’s done/applied for/been told, and then you can figure out the next step. If she’s really not sure what happened at the consulate you could do a FOIA request to get her records.

The 2023 carrier guide, page 32, states a person with a 10 year expired card can board.  Whether a particular airline will honor that is another story.  I agree she would not been applying for an immigrant visa.   If they denied her a boarding foil, she is not in a good situation.

Although technically she should be allowed boarding, she would be better off if she had an I90 NOA receipt.
