Hi everyone, I'll shoot straight.

 

My wife lives with her parents and now I live with them too, my circumstances have changed drastically and I need to get documents to prove I won't be a public charge. 

 

Her parents don't work, my wife doesn't work due to health issues but pays rent and the only joint sponsor I have is her brother who will use his property as an asset for me on his Affidavit of Support.  

 

- Considering our household size, do her parents file an affidavit of support for me too? Are they even included when they ask about household? 

 

- What documents and forms would my brother in law need for this?

I recommend finding a more qualifying joint sponsor. Assets are hit or miss, especially if these assets are neither yours or US citizen spouse's.

 

Household size is whoever is on US citizen's taxes + whoever she sponsored before (if not a citizen yet) or sponsors now - you.

 

 

 

I really wish I could but he's all I got and the house is valued a good chunk. I guess it'll have to be a gamble to see if they'll accept it.

Is this house his primary residence?

If yes, he cannot use it as an asset. Don't set yourself up for failure, find a better sponsor. Otherwise you may get RFE, NOID and denial down the line and lose all your filing fees. Good luck!

Does sound this is not an investment property.

 Wife is not able to work for health reasons but is able to pay rent to parents, so she must have an income of sorts

USCIS accepts SSI and SSA or employer short/long term disability

Each year she should get a letter with the information about the following year's payout / she should also get I 1099 for each year showing what was paid out that year

 

statement needed that she does not file tax returns
