FIOA request was done through senator. But the reason they gave us was completely different not the photo of marriage. They claimed my wife was already married which is completely false. Yes, she is married to me. ( We gather official document proofing such nature for both of us in Pakistan)

Ah, if you'd mentioned that before it would have made more sense.

Are you sure she's never had or applied for a B visa before she met you? And claimed to be married on the application for it?

No she did not. I always filed paperwork behalf of her when needed.

No agency has ever filled out a visa application for her?

Never left the country before she met me. After she met me, we traveled few countries together already.

I asked because it has caused some people big problems.

Hello,

Did DHS send you a receipt when you sent your I601a application?

I am in the same situation, my husband was misrepresented at the k1 visa interview in 2018, got married in 2020, filed for a cr1. At the interview may 2024, officer told us that he needs a waiver. I filled the waiver since may 1st, they withdrew the payment may 6th but have not received any notice yet.

Why did you not file a waiver in 2020

If you read my post you would not asked that. The was on AP, they never gave me a response until I contacted the congressman office to contact the embassy, that’s when they said to apply for a different category because the k1 past the 6months deadline because of covid. Never requested a waiver.

married 2020, apllied for cr1, interviewed last year may 2, 2024. That’s when the officer told us he couldn’t approve the ir1 visa because of the misrepresentation for the k1 visa in 2018, but he will contact us. 30 days later we received a denied letter requested a waiver.
contacted a lawyer june 2024, she emailed the embassy to find out the reason, they never responded. Contacted congressman office March 2025, they said I need to do the waiver so they can remove the misrepresentation from our case.

Waiver submitted may 1st, payment received may 9, but until now no receipt.
