Before the I-130, I had applied K1 before which was approved but I did not met wife at that time. So, it was invalid. Then we got married and applied for I-130.

Can you post the denial notice (taking out any personal info)? It really doesn’t seem right that they haven’t just asked for more proof of a bonafide marriage.

They did not have issue with bonafide relationship as we have a tons of proof that we provided. Living together, trips together, being with family together, chats/calls and photos. You name it and everything was provided. But for your sake I will upload the denial notice shortly.

Presumably relating to evidence supplied for the K1

I was hoping it would have more info than that. Did you get a proper letter specifying the misrepresentation/fraud after the interview? It still seems odd that it's only due to wedding photos. 

 

Unless as Boiler said, it's to do with the K1? But your lawyers should know more details and hopefully have put a really good case together for your waiver.

So after the interview the officer handed over this notice and told my wife have your husband file a waiver and you should be good to go. When my wife asked why is now getting denied the officer didn’t really gave her clear answer. I had fought the decision and got denied with this above explanation that the photos felt wrong timed ( wedding pictures does not match what we are presenting). Basically we mis represented material fact that’s what they claimed even though it’s completely wrong. Fast forward… i end up filling waiver with help of a lawyer. But its hard now cause its taking forever. We were married in 2020, its been more than 5 years now living apart.

Did you not get a formal denial notice/letter?

No, they did not provide us with exact details. I had to struggles 1 year to find out why exactly they denied with the waiver option only. Even then this does not makes sense. 

No official notice, I reached out to senator office and have them email behalf of me to find out the actual reason. I believe that was not the main reason. I am not originally from Pakistan, I am a U.S. Citizen and  my parents are from Bangladesh.

When you log in to check the status, is there definitely nothing on the documents tab? I think I would do a FOIA request, and in fact I'm really surprised your lawyers haven't done that. I don't understand how they can put a waiver case together without knowing the exact reason for the denial and inadmissibility?

 

There will be a bigger reason than just photos I'm sure. And I'd be surprised if your wife didn't know more about it after the interview.

FIOA request was done through senator. But the reason they gave us was completely different not the photo of marriage. They claimed my wife was already married which is completely false. Yes, she is married to me. ( We gather official document proofing such nature for both of us in Pakistan)

Has she ever claimed to be married on another US visa request?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
