Our I-130 was approved in June and we have moved onto the NVC process. I am filling out the affidavit of support, and have a few questions about income

 

My wife is Thai, and i spent the first half of 2024 with her in Thailand, and I didn’t start my new job until August of 2024. The income on my tax return/W2 is under what is required. My current income, and projected income for 2025 is enough, and i plan on submitting 6 months of paystubs, my W2, and my tax transcript, and a letter from my employer with the I-864EZ. Am i correct that this should be sufficient proof, and that I shouldn’t need a joint sponsor?

 

Should i be mistaken, my mom has said she would joint sponsor. We live in the same household, so would she fill out the standard I-864 or would she fill out the I-864A? She files her taxes jointly, so would my dad also have to sponsor, or could i just send the tax transcript, with proof of her income separate of my dad?

 

I’m hoping i can do this on my own without a joint sponsor. Thanks in advance for any advice.

Hard to say if the consulate will request a joint sponsor (I am not familiar with Bangkok).  I would have your mother fill out an I864A since you live in the same household just in case.

Do you know roughly how long it takes in Thailand to get an interview? Because it will be even longer than 6 months of proof by the time you get to the interview (where your spouse should show most recent pay-stubs, etc.), which depending on how long that is, might be plenty. 

 

I was in a similar situation, where I was living in Chile with my wife and only moved to the US with a new US-based job about a month before we sent in the i-864 to the NVC. So they documentarily qualified us, but they put in the comments that we might need a joint sponsor. So we got my father to be a join sponsor, but we didn't submit it to the NVC, and just brought the signed form to the interview, basically just in case they required it. But by the time we got the interview I had closer to 6 months of employment, so they didn't end up requiring a joint-sponsor. 

 

All that to recommend that you send in to the NVC with just your income, and then just have ready the joint-sponsor documents ready for the interview if needed.

I think if you look at any of your pay stubs, you'll see they show year to date income.  One is enough.  The affidavit of support does not ask for your projected 2025 income.  It asks for "current income".  In your case, that numbers may be the same, but the formula is gross pay for a pay period times the number of pay periods in a full year (any full 12 months).  So, if you make a grand a week, starting last month, your current income is stated as 52k.  Has nothing to do with any calendar year.  Past tax return information is all that goes by calendar year.

Facts are cheap...knowing how to use them is precious...

I need to add that you do not qualify to use the I-864EZ.  Use the full version, joint sponsor or not.

Can you explain why? Is it because my W2 doesn't show sufficient income and I need to use paystubs?

Close enough.  You cannot correctly answer all three qualifying questions. Best not to try to force the issue.  You definitely cannot use the EZ if you use a joint sponsor.
