Re-Entry with IR5 visa-Green card lost in mail

Hello everyone,

 

My mom arrived to the US with IR5 visa (Parent of US Citizen) 2 months ago. I am pretty sure USPS lost her green card.

If she leaves USA would she have problems to re enter again with IR5 visa without green card?

Has anyone experienced the same?

Her endorsed IR5 visa will act as a temporary GC for 12 months (see the note printed on the visa).  As long as she plans to return in that period, she will be fine.

Thank you, USCIS has a live chat option to chat with a real person. This is what they told me now:

 

You will have to get appointment with local office to get temp proof of status while I-90 app is processing. You can request for the appointment once you receive receipt number for app I-90.

That would apply after the first twelve months go by.  As to today, your mother has a valid proof of LPR status with her endorsed visa at least for the next 9-10 months.

How long is she looking at being gone?

 

She has her stamp.

 

Not unusual for GCs to take more than 2 months to be issued.

 

Presume the fee has been paid.

 

If lost has she applied for a replacement?

She plans to leave in August and back in early January.

USCIS mailed her green card on June 2, but when I track there is no activity since June 3.

I assume and I know they lost it.

I have not yet applied for replacement, I want to wait till Tues, or Wed next week

OK, so only 4 days so far in the USPS system.  I would not assume it is lost at this point.  No activity could mean it is currently at a major sorting location before it moves on to your local post office for eventual delivery.  Could show up in the next few days.

 

Regardless, her stamped passport which occurred in March/April should be fine for this trip as it will still be valid in January 2026 (See US CBP Carrier Guide).  If you are worried, you can contact USCIS and request "ADIT stamp".

I understand the consternation, but your mother is an LPR regardless if she has the physical GC in her hand, and she has alternatives for her upcoming trip if the physical card is in fact lost.  If you think her trip will extend out past the validity of her temporary GC currently in her passport, then get an ADIT stamp prior to her departure.  Even if the card is lost, there is no way she will get a physical GC via an I90 filing in time for the trip.

It means, and yes, it is a temporary I551 that is stamped in an LPR's passport.

How do you know they lost it?

Letters and cards sent by USCIS can take 2-8 weeks to arrive by USPS.
