So I met my girl while studying abroad and we are still in the same country for another year but we want to get married and return to USA together as I am a USA citizen and start a life. Here are my questions.

 

  1. Your mailing address . -Should I put my current address that is outside of the country or use my parents address ?

2. ⁠Address in the United States where your beneficiary intends to live.

 

⁠we don’t have an apartment set up for a year from now however right now I’m working remote and I have about a very good amount of money saved that I plan to get apartment as we arrive in America however we will probably stay at my parents house for about a month . But with that being said we will move to another state that I used to live in. So should I put my parents address again. And write that we will be moving within the 3 months and get married in a different state ?

 

1. ⁠Part 3 other information 4.a I checked yes . As I have had a dwi back in 2012 but this information does not say anything about having to show records so will this hurt my chances of getting approved ?

 

also she’s a Chinese national

K1 will take long  than a  year

Do you mean you want to get married where you are and return together to the US? If so, then this is not a K-1 Fiancée visa situation... This would be an IR-1/CR-1 spousal visa situation and would not be done in a year. If you are engaged and want to do the K-1 visa, you would need to get married in the US once you both go there. We got Jaycel here in 50 weeks using the K-1 but that was in the prior administration and things seemed to slow down a bit on the K-1s since the new administration came into office.

If you pursue the K-1 visa you MUST give them court certified records of the case disposition or you will get an RFE. I made the mistake of not sending them in with my application, because like you, I misunderstood the instructions and thought I just had to give them the information. I got an RFE and it delayed my case by who-knows how long.

There's no way to know for sure.... a lot depends on which embassy will be doing the interview and visa issuance.

Average time says about 1 year everywhere I have looked

Because we were able to get Jaycel's interview scheduled and visa in-hand in about 2 and a half months after the date of approval from USCIS. Now it seems to be taking USCIS 6-8 weeks at least just to send the approved application to the NVC and it's usually 4-6 weeks more before they send it to the embassy now. Things have slowed down a lot over the past 6 months. We were extremely fortunate to get ours as quickly as we did

So you think on average it’s going to take 2 years ? Or what is the ideal realistic time ? A little over a year ?

I would say to bank on at least 14 - 15 months. The hardest thing about this immigration process is managing your own expectations. The 2nd hardest is not comparing your case to others that filed around the same time as you.

A couple of things. Having 'quite a bit of money saved up' doesn't meet the income requirement unless we're talking about over $140,000. The USCIS generally requires income and they like to see a steady or increasing income not just savings.  it's perfectly fine to use your parents address, you need to use a US address to help show that you two intend to reside in the US.  You should consider a spousal visa instead. 

 

The DWI in 2012 won't make a huge difference unless there's a pattern of disorderly conduct 

 

Chinese nationals experience longer processing times due to background checks and other administrative processing so be prepared for that.

No one will be able to give you a specific timeline. There are a lot of factors involved and there is very little transparency. Count on at least a year going up to multiple years. As you are currently together I would highly recommend going for the spousal visa as it is cheaper, could possibly be faster in the long run and your spouse will be able to work, drive and travel immediately after moving to the USA. Being able to work, drive and travel are very important in the US and directly affect your quality of life.
