When can i file sponsor paperwork?

Hi, guys!

I wanna ask question, my husband and I want to apply spousal visa I-130 and adjustment status, and my question is, can we submit sponsor or co sponsor paperworks few months after we file I-130, work permit, and adjustament status? Or when are we supposed to file that sponsor paperwork?

Filing for a spousal visa and filing for adjustment of status are 2 completely different processes.  Which one are your referring to?  Is the foreign beneficiary inside the US or outside the US right now?

If you are talking about filing an I-485 for adjustment of status, failure to file the I-864, affidavit of support at the same time, will result in a denial.

If your other post is accurate, it appears you are the beneficiary, and were in the U.S. at least in February.  What is your current location?  As @Crazy Cat stated a spousal visa and Adjustment of Status (AOS) are two different things.  If you are still currently in the U.S., then your U.S. citizen spouse and yourself should research the guide below for AOS.

Yes I'm in the US now. So what do you think the steps i need to take for filing those papers? Or i need to file all those papers at the same time.

The I130 can be done separately, more specifically before, or together with the I485 package, but when filing the I485, the I864(s) have to be submitted at the same time.

Adjustment of Status.  @Dashinka posted the link for the guide you need above.  Good luck on your journey.

 

Be aware that you cannot work or leave the US for 3 to 6 months.

If you file the I130 now, you will need to wait for the acceptance NOA from that filing before filing the I485/I864 and other forms if desired (I765/I131).  I would recommend you file everything together.

File them together in the same envelope (Concurrent Filing) Highly recommend that you also file the I-765 (Application for Work Authorization) if you have any desire to work while waiting for the green card to be approved
