A Morgantown man, his mother and his friend are suing McDonald's for $10 million.

The man says he bit into a hamburger and had a severe allergic reaction to the cheese melted on it.

Jeromy Jackson, who is in his early 20s, says he clearly ordered two Quarter Pounders without cheese at the McDonald's restaurant in Star City before heading to Clarksburg.

His mother Trela Jackson and friend Andrew Ellifritz are parties to the lawsuit because they say they risked their lives rushing Jeromy to United Hospital Center in Clarksburg.

If you're that allergic to cheese, wouldn't the safe bet to always check first before eating, even if you did request a certain item be left off your burger?

Seriously, what a loser! Just what the world needs, more frivolous lawsuits.

Seriously, this is stupid. McDonalds mess orders up all the time, if you have an allergy that is that severe, you should probably avoid eating there in the first place.

AOS TIMELINE

16th December 2005 - Sent I-130, AOS, EAD & AP USPS overnight to Chicago Lockbox

18th December 2005 - Received at Chicago 9.18pm.

23rd December 2005 - NOAs for I-130, AOS, EAD, AP!! Didn't expect them that quickly

13th January 2006 - RFE for Medical and additional I-864 info

17th January 2006 - INFOPASS Apt about RFE.

23rd January 2006 - Appointment notice for Biometrics on 10th Feb.

10th February 2006 - Biometrics Appointment

21st February 2006 - Medical. Cost $250 including all blood tests, Td Shot, TB test and Titers for MMR and Varicella.

27th February 2006 - Appointment with immigration lawyer re. RFE for I-864.

1st March 2006 - Final results Medical. Papers in hand to send.

10th March 2006 - RFE responses to Lees Summit

13th March 2006 - RFE responses signed for at Lees Summit

24th March 2006 - Emergency AP approved in Omaha

28th March 2006- Collected AP

31st March 2006 - EAD Approval online

7th April 2006 - EAD arrived in mailbox.

21st April 2006- Received Interview Date for 22nd June

9th May 2006- Received SSN

22nd June 2006- AOS INTERVIEW APPROVED

REMOVING CONDITIONS

June 20 2008 - Package mailed to CSC under new rules. Would have been an NSC transfer

June 23 2008 - Package recieved at CSC

June 27 2008 - Recieve NOA1

July 16 2008 - Biometrics

July 17 2008 - Touched

September 9 2008 - Card production ordered

First, I don't think McDonalds uses real cheese - I believe it is called processed cheese product. I'm curious what exactly the man is 'allergic' to? :unsure: Validity to his claim depends on whether he previously was diagnosed by an actual allergist who specifically told him what food substances he should completely avoid and then whether the man has followed the doctor's orders consistently.

McDonalds is notorious for adding so many types of additives into their food that chances are, many of the substances in the cheese product are also contained somewhere else in his meal.

It's laughable that someone who'd have such a serious food allergy would even dare step into a place like McDonalds...it sounds fishy to me.

The guy has probably been asking for a Big Mac without cheese for the last 5 years hoping one day they'd ###### it up and his pay day would arrive.

Anybody really allergic to something like that would have looked in the damn burger before biting into it. I mean, who would put their lives in the hands of some spotty teenager who works at McDonalds?

Many people self diagnose and believe they are allergic to certain types of food, but without a doctor's diagnosis and regiment, I don't think someone has a legal leg to stand on if they try to sue a restaurant for serving them food containing something they told the server they were allergic to. Even in cases where someone has been diagnosed to be allergic to shellfish, for example, would have a hard time proving liability to a restaurant if they simply told their server they cannot eat anything with shellfish in it. It's their responsibility to find out what ingredients are in their meal and decide for themselves whether they can eat it or not.

It will be interesting to see how this man's attorney tries to establish liability and whether or not the jurors will be buy it.

That would be called a McFishy.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.
