Good afternoon, 

My husband wants to start the process to bring his child from Cuba to USA filing Form I-130.  The child is 10 years old and he was born out of wedlock.  We started the application and we should submit evidence of the relationship between my husband and his child.  We need to submit a written statement( Affidavit from the mother of the child and any other relative) to prove that my husband has been in the life of his son.  I would like to know if anybody can share any similar written statement so i can have an idea how they should do the written statement.  Any help in this matter would be greatly appreciated.

Does he have his child support properly recorded?

Hi Boiler, 

Thanks for trying to help us.  My husband doesn’t have all child support recorded because with Cuba it was difficult to send money.  Western Union was working for almost 2 years and we have a couple of receipts through western union, for that reason we need the written statement from the child’s mother and another relative.

i would at least make sure he is up to date.

Is your husband a US Citizen?  Was he already a US Citizen when the child was born?  Has the mother given permission for the child to live in the USA?  Please answer those three questions first, so our assistance can be in the correct context.

Hello Pushbrk,

My husband is a US citizen and his child was born before he received his US citizenship. The mother of the child is already in USA and they both agreed to bring their child to the United States.  Hope this information will help you and thank you so much.

How did the Mother immigrate?

 

Why did she not bring the child.

 

Who has custody?

OK.  So, you follow the immigrant visa process for a child, which is similar to that of a spouse visa, with different documentation.  The child's birth certificate naming his now US Citizen Father is the relationship evidence you need.  When the child arrives, instead of getting a green card, you just apply for the child's US Passport.  You can also file for Certificate of Citizenship for the child, after arrival.  My personal opinion is that is not necessary though.

Thanks for letting me know, I thought he had to go to green card process in order to apply for citizenship after approved I-130.

Not for the natural child of a US Citizen.  They become citizens upon arrival to reside with the US Citizen parent.
