Hello,

 

I am a US citizen, and have lived in the UK for most of my life. I have a US passport, and a visa to live here in the UK.

 

Me and my fiancé submitted form i129f to start the k1 visa application process. 

 

We are both aiming to move to the USA to be with my parents who are not well.

 

Regarding financial support, I am worried about myself as the US citizen sponsor, that I do not live in the US currently.

 

Am I required to complete form i134 for my fiancé to take to her interview? Or is that for other visa types? Do they take savings into account? How much savings would be needed? Or would my parents need to co sponsor?

 

Really worried about this, so any advice is appreciated.

K1 seems an odd choice, will your Parents be your Joint Sponsors.

 

Are you up to date on your US Taxes?

I wasn't aware of needing a joint sponsor or sponsor from someone else with me being American. I last lived in the USA 5 years ago and that is when I last did my taxes. I also lived and worked in the US 12 years ago and taxes were all done then as well. 

 

We were guided down this visa route as per recommendation. 

 

Any advice appreciated

Every couple has their own priorities, and each couple must decide which visa is better for their situation.

K-1 
  More expensive than CR-1
  Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)
  Spouse can not leave the US until she/he receives approved Advance Parole (approx 3-6 months) 
  Spouse can not work until she/he receives EAD (approx 3-6 months) 
  Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period 
  Spouse will not receive Green Card for many months after Adjustment of Status is filed.
  A K-1 might be a better choice when 18-21 year old children are immigrating also
  In some situations, marriage can affect certain Home country benefits, making a K-1 a better choice 
  A denied K-1 is sent back to USCIS to expire
  K-1 entrant cannot file for citizenship until after having Green Card for 3 years.
  Once an I-129F has been approved, delaying the case is difficult to impossible if the need arises.


CR-1/IR-1
  Less expensive than K-1 
  No Adjustment of Status(I-485, I-131, I-765) required. 
  Spouse can immediately travel outside the US 
  Spouse is authorized to work immediately upon arrival. 
  Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US 
  Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.
  Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.
  The clock for citizenship filing starts immediately upon entry to the US.
  A CR-1/IR-1 case can be delayed indefinitely at NVC if the need arises.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I assume you need to catch up on filing your taxes.

 

K1 would not be my recommendation.

 

I would read the guides make sure you are familiar with the process.

you'll need a joint sponsor

EDIT: if your partner is Polish, make sure they have a Polish police certificate by interview or NVC stage for spousal (I think?). There's sometimes confusion for people who left their birth country young, no idea if that's your situation

K-1 makes no sense.

 

Especially if finances are an issue.

 

But with either fiancee or spouse visa, you need to have domicile/US based income in order to petition someone for an immigrant visa.

 

You need to be up to date on your taxes.  Sounds like you're getting bad advice?  Best source of legitimate info on this process is USCIS.gov and Visa Journey.  I'd forget about TikTok or other sources.  

 

Overall, US immigration is not cheap, easy or fast.  You'd do well to do as much reading and research as possible - it WILL save you money and time.

The K1 visa is the one out of all the research we did, all on the sites you mentioned, that was the most suitable for our situation. The unique part of it is that I live in the UK and not the US. I have done further research on this step, and believe a sponsor from my parents, along with proofs of savings and assets go towards, if no US based income. Just cannot seem to find what amount of savings or assets are required.

You will always be the sponsor

for k1 you need 100% of poverty line and assets need to be 5x the income req, think just over 100k now?
spousal is 125% and assets need to be 3x

Your parents will be cosponsors, so you'll both fill out an i-134 (or I-864 if you go spousal)

I am not up to date on spousal or if you can do consular processing but I think spousal takes about 12-18months on ave in London
Fiance is taking 6-8months

Spousal is the better financially and giving your partner right to work/drive etc but if time is main priority, which it may be here with parents being ill, K1 may be better. As I say, not up to date on spousal route so I could be wrong but 'what is fastest' is not usually what people consider when advising here, for me that was a big factor which is why I did k1.
