The law (INA § 204) has always required that the self-petitioner have lived with the abuser during the qualifying relationship,what has changed with the new interpretation is that USCIS is applying this requirement more strictly, paying closer attention to whether the residence is still ongoing or if the separation is clearly connected to the abuse.

Let’s say if someone got a protective order against the abuser is this a good ground as well and if you file as a In person since you can not afford an Attoney will this be ok or filing with attorney is more secure and reliable before USCIS in VAWA case

Does it mean that if you divorce your abusive US citizen spouse without had lived with him for the required time frame makes you ineligible for applying citizenship under the 3 years rule provision?

Can someone break this down to us?
