USCIS updated guidance in Volume 3 of the USCIS Policy Manual related to the Violence Against Women Act (VAWA) program

https://www.uscis.gov/sites/default/files/document/policy-manual-updates/20251222-VAWASelf-Petitioners.pdf

The law (INA § 204) has always required that the self-petitioner have lived with the abuser during the qualifying relationship, what has changed with the new interpretation is that USCIS is applying this requirement more strictly, paying closer attention to whether the residence is still ongoing or if the separation is clearly connected to the abuse.

Let’s say if someone got a protective order against the abuser is this a good ground as well and if you file as a In person since you can not afford an Attoney will this be ok or filing with attorney is more secure and reliable before USCIS in VAWA case

Does it mean that if you divorce your abusive US citizen spouse without had lived with him for the required time frame makes you ineligible for applying citizenship under the 3 years rule provision?

Can someone break this down to us?

Compliments of the season to you all!

It has been a while that I wrote in here, even though I’ve been reading all the updates as much as I can. And I also never updated you all on my case.

Our green card was approved in April after the mandamus I filed. The journey was long 2017 - 2025, but this platform helped me tremendously through it all! Thank you. (For those that don’t know the story, please check my previous posts).

Also, my son joined the army in October and just last week became a citizen! I now have 2 citizens! Glory be to God!

Just want to encourage anyone out there still going through the process or about starting. There will be bumps along the way and naysayers, hold on to your truth and stand tightly by it. There is light around the corner!

It is Wednesday -- time for our approval-evoking* Semiofficial Semiweekly VAWA-Thread Joke:

     *if correlation = causation

===========================================
VERY PUNNY

A ham sandwich walks into a bar and orders a beer.

The bartender says, "Sorry, but we don't serve food here."

What lights up a soccer stadium?

A soccer match.

Why shouldn't you write with a broken pencil?

Because it's pointless.

What's brown and sticky?

A stick.

Why do people say "break a leg" when you go on stage?

Because every play has a cast.

What do you call a pig that does karate?

A pork chop.

Why do seagulls fly over the sea?

Because if they flew over a bay, they would be bagels.

How do you tell if a vampire is sick?

By how much he is coffin.

:P

One of my close friends is a victim of abuse and is preparing to file their case for the first time. We are looking for guidance from anyone who has experience with this process.

We would sincerely appreciate help with the following:
• How to properly organize the file from the beginning

• Preparing the covering letter

• Required forms and the correct order

• Drafting the personal statement of the abuse victim

• Including evidence such as medical or battery records

• Proof of a good-faith marriage

• Abuser’s citizenship documents and moral character evidence

. good moral character of the applicant

We would also like guidance on technical details, such as whether page numbering using a pencil is acceptable or if another method is recommended.

Any guidance, resources, or advice would be deeply appreciated. Your support could truly help someone who has already been through a very difficult situation.
