Hello family, I had my Vawa i-485 since July and silence since then. My lawyer is recommending suing but i do not want to go through that route. For those who already have their green cards, how long did it take for you to hear back after interview

If it is over 90 days since your interview then i would say either make the appointment or reach out to your congress person.

mine is over 90 days too. Vawa was approved since May 15th. going on 6 months now. It's unbelievable

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

@Rhema1 been a lurker in this forum but I'm preparing to file my N400 under 3 year rule. What kind of documents did you submit? Did you submit approved I-360, tax transcript and proof of marriage/ divorce?

If you are filling under an approved I-360(vawa)

Marriage/divorce are not required.

Your approved proof is not mandatory as well because they have all those informations already in their system and the copy of your green Card has your ground of eligibility on it as proof.

Follow the USCIS N-400 checklist.

If it's the same marriage, it means that the marriage/divorce certificate was already submitted during the green Card process with your form I-485.

It's not mandatory under vawa provision in the N-400 process.

It's written even in their instructions. But with the general provision: YES 

But if you want to resubmit it, up to you.

Vawa  provision has a special protection different from other provision

Instructions clearly say:

 

All applicants must provide (if applicable)

LPR Card (Green Card): A copy of your Permanent Resident Card (also known as a Green Card) (both sides)

Form N-648, Medical Certification for Disability Exceptions: If you have a physical or developmental disability or mental impairment that prevents you from complying with the English language and/or civics requirements for naturalization, submit a completed Form N-648 to request an exception to the English language and/or civics tests.  

Marital Status: Provide current marriage certificate and any divorce decree, annulment decree, or death certificate showing that your prior marriages were terminated (if applicable).

But have you read those who are filling under vawa provision specifically?

We are Not talking about general or married to a US citizen provision.

Kindly take a look on that and let me know. May be I'm the one not understand it very well.

All applicants is everybody, including VAWA, General Provision, Marriage based, Military provision etc. It says there is required evidence for all applicants when it comes to marital status. Just like all applicants (including VAWA) must submit front and back of their GC with N-400. I'm not talking about evidence of bonafide marriage etc. Simply doc that proves marital status.

 

Married - marriage certificate

Divorced - divorce certificate.

 

 

I applied under general provision. I got GC through spouse, and still married to same spouse. I provided same marriage certificate for I-485 and N-400.

 

The naturalization certificate shows marital status at time of naturalization. N-400 form asks for marital status even if filing under VAWA. The certificate (marriage or divorce) is proof of marital status.
