Any information on a potential Visa?

Apologies for the late reply we’ve only just received some sort of answer all be it not very useful. The lecturer confirms that the +1 can be for pretty much anyone including friends and relations. They apparently will not have the full documents until April so that is likely when we will know more. 
 

Going by what you’ve all said there are no visas that allow for this as a true +1, so could this be a situation where the +1 gets a whole un-related visa and just lives with the other?

 

Apologies if that sounds stupid I have no idea about any of this and no idea where to look.

If the +1 was for example a US Citizen there would be no issue and they would cover your expenses as defined.

 

But you are not so the only option you have currently is to visit, I assume you can use the VWP which is up to 90 days, I would not push it that far, and that you will find out in April what sort of expenses they will reimburse, flights, living costs whatever. Maybe x flights a year and a per diem?

Sounds like you are just visiting via VWP.  To answer one of your questions, you can NOT work inside the US after a VWP entry.  Your stay will limited to 90 days max.  Overstaying would not be wise.  I'm still interested in knowing in what capacity the student is entering the US.

With the greatest of respect to the lecturer, I wouldn't trust what they're saying, it's just not their job to know about this kind of thing - surely the university has somebody relevant that you can talk to about this with some visa knowledge? You really need to find out what visa your OH will be on as a starting point, and they should be able to tell him that now. My daughter is doing a degree at a UK uni with a year abroad, she's already had info about visas for it and she doesn't even start the degree until Sept! She's a green card holder so nice and easy for her, but my point is that if the uni does exchanges/study abroad years then they must have info for you, I would ask somebody else rather than a lecturer. 

 

You can look on the USCIS website for info on visas, as you'll see from that you MUST be legally married to go as a dependent, the US simply doesn't recognise unmarried partners for the purposes of immigration. 

 

The only possible option that springs to mind  is the B2 in lieu of H-1B, but that's quite a rare beast and you'll need to look up to see if you think you'd qualify for it. But again, if the uni is telling you that you can go with him, they must have a visa strategy in mind so I'd push harder and ask them for clarification. You can't be expected to wait until April, if he's starting in Sept that could be far too late to even get a visa for then.

Did they answer which visa your partner (the student) will be on?

I would ask the lecturer to put you in contact with the study abroad program/ the program allowing your partner to go to the US for a year. 

Everything I know about study abroad usually involves the student going alone and not with anyone else. 

 

Do you also know which institution your partner will be studying at? You could do a search on the US university's website to see if they have any information about the program your partner is going on and the visa required/partners joining etc. 

 

I would also like to say: US immigration is not fast at all and changing status inside the US on ESTA is not allowed (changing status to a non-immigrant visa). 

You are also not permitted to extend your stay... so you'll only be allowed to stay for 90 days before needing to return back to the UK. 

 

Extending your stay

If you enter the United States under the Visa Waiver Program, you are not permitted to extend your stay in the United States beyond the initial admission period. You must depart the United States on or before the date on your admission stamp when you entered the United States.
