Affidavit of Support with Assets Only

Hello everyone,

 

My wife and I's I-130 should be approved in the next 3 months. It has me thinking about the affidavit of support. I currently don't work and have not been able to work for the past 2 years.  I do have enough money to cover the amount necessary to sponsor my wife due to an inheritance. The majority of that money is still in the estate account that I've been pulling out here and there to deposit into my personal bank account. 

 

What I'm wondering is if it will look bad if I decide to pull out all that money at once to deposit into my bank account so close to the eventual filing of the affidavit of support? Unfortunately it's the only shot I have of sponsoring my wife due to medical issues so I'm hoping it wouldn't cause issues. Any opinions or advice would be appreciated. Thank you.

I would get a qualified joint sponsor.

You can certainly try to use assets but based on my own personal experience, definitely have a joint sponsor lined up. We were hoping to use just assets and, despite having plenty, they gave us the 221g at the interview for a joint sponsor; fortunately we had one lined up, however reluctant, and it did add an additional couple of months to the processing.

Yes, it will look bad.  Joint sponsor is a much safer way to go.

The idea that using your  own liquid assets instead of income, makes it less likely you'll qualify, is an overreaction to incomplete data.  Obligating a joint sponsor, is a last resort, because that contract is a very big deal, not just words you type.

 

You should have well over the three times the income shortfall though, and it must be liquid.  It must also be clearly evident the liquid assets are owned by the sponsor.

 

Whether to move money from an "estate account" to a personal account requires more information.  Is there more than one owner of the "estate account"?  Another executor, etc.  If so, definitely move it but also be able to track your ownership of those assets.
