Acquiring US Citizenship For A Child Born to A US Citizen in Canada

Hello Good Day Everyone, 

 

just needing a help with a certification. i am a dual citizen, US and Canada. i moved to US in November 2011 and lived in US until July 2017, my primary residance for those years was soley in US. i got married in early 2016 in Canada and when i received my Canadian PR in 2017, i moved to Canada in 2017, and since then my primary residance have been in Canada. My i gave birth to my daughter this november and i am looking to apply for her US birth certificate and passport. 

 

my question is ,

1- will i encounter any issue while applying ?

2- what is physical presence calculator ? do i need to have lived in US for certain period. 

 

your response would be greatly appricated ?

To qualify for a Consular Report of Birth Abroad (CRBA), a child must meet the following requirements: 
At least one of the child's parents must have been a U.S. citizen before the child was born
The child must be under 18 years old
The parent must have been physically present in the United States for at least five years before the child's birth

 

How easily can you prove your presence?

Hello, 

thankyou for your response, Yes i am and was a US Citizen before my child was born. my child is about one month. No problem proving that. as i mentioned, i came to the united state in november 2011 with my parents and lived with them till 2017 before i moved to canada with my husband. I do have all the tax filled up, my w2 for the year i worked. Plus also my high school transcript.

Just to clarify -- for a CRBA, the requirement is actual physical presence (i.e., the hours/days/weeks/months/years) you were in the US.  You cannot count any time you spent outside the US for any reason, including vacations or family visits. 

 

You need to have 5 years physically in the US,  at least two of which must have been after you were 14 years old.

 

How did you get your US citizenship?  Did you spend any time in the US for any reason prior to Nov 2011?

 

When in Nov 2011 did you come to the US?  And, when did you leave in 2017?  All of 2012 through all of 2017 would only be five years -- assuming no travel at all out of the US during that time.  Add the few weeks in 2011...but, it will be really close unless you had time prior to Nov 2011.

I just wanted to update everyone on my recent experience, i had my daughter appointment for CRBA couple of days ago, i was able to prove that i stayed in US For 5 Years, Which i did, my high-school transcript, collage transcript, my immunization record, tax filled up. the processing officer asked did asked me about my stay in US and when i moved to Canada, i was honest and told them about my stay, afterward, the officer congratulated us and my daughter, she is a US citizen, her CRBA should come within two week,
