I talked to my attorney today. He said he has been getting a lot of approvals through CSC at the 4 month mark.

Have we ended the whole: "They go by when they receive the petition/They go by the NOA1 issue date" debate? According to my attorney again, Our petition was sent out on 6/04 and received by NSC on 6/07. If that is the case, I must be getting close...if they are going by when the petition was received.

I am at 4 1/2 months and stilll waiting. My issue date is 5/27. I see someone was approved today from Nebraska that filed on 6/1 and had an NOA1 date of 6/14. I am very happy for them but what about people still waiting from May. How does this happen?

Here is their timeline- You can see they are not truly June filers, but February 2006 filers.

Nebraska Service Center

HCMC Consulate

K1 Timeline

2/27/06 I-129F Sent

5/5/06 petition sent to NVC

10/6/06 first interview- Blue slip request more evidence

10/18/06 sent evidence of relationship and timeline on how we met

10/26/06 2 interview-Green slip visa denied section 221(g) consulate called it a sham

12/6/06 sent back to NVC

1/24/06 NVC sent case to CSC

2/6/07 Arrived CSC

2/17/07 Filed FOIA to see consular notes

4/19/07 CSC tells my congressman Liaison that they have no record of receiving my case and they can't look for it until the FOIA is scanned.

4/25/07 Receive letter from NRC DHS USCIS that states it will take 12-18 months to complete FOIA request

4/30/07 My case was scanned for the FOIA and now CSC can look at it. I chose to cancel the FOIA request

5/01/07 CSC locates file. They say that they don't know why it was sent to them and not NSC. They also say that they don't send petitioner any notification and it is expired and I can file a new petition.

5/21/07 Preparing to send in a new I129

6-1-07 Mailed new I-129F petition with IMBRA waiver.

Looks like a June 1 filer to me. The first petition from 2006 was approved and they were rejected at the interview. The June petition was a brand new one. It does not look like the second petition was expedited although they do seem to be a little ahead of the pack.

In any case, what an ordeal for them! I sure hope things go better this time.
