We are going through the K-1 process. I am anticipating that my fiance will receive packet 3 from the embassy in Guangzhou China around November or December. Her interview will hopefully be late January or February next year.

Here is my dilemna. My W-2's from the last 2 years are insufficient. My income this year is great, which of course will show up on this year's W-2 this coming January.

Do I need to submit my W-2 to my fiance when she returns packet 3 (I hope not), or do I send it to her just prior to the interview (I hope so!)

I probably shouldn't obsess so much about the W-2 thing, since my paystubs and employment letter will show adequate income; I just want to know the answer on when W-2's are actually required to be provided to her, so I can have some piece of mind on this.

Thanks for any assistance, opinions, etc.!

There is no expiration on a W2, it is just a record documenting gross income, and taxes paid.

What you do is provide past 3 years IRS transcripts showing gross income, as well as a letter from your employer indicating your current annual gross income, nature of your work, and if job is a permanent one, as well as a few recent pay stubs, you can estimate your 2007 gross income from the pay stubs, as well as the employer letter will satisfy GUZ.

Get IRS transcripts, the simple ones, you can order them on the phone for free.

In our case this what the I-134 included.

  • I-134 signed and notarized.
  • Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS
  • Photo copy of IRS form 1040, and W2s for past 3 years
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past 6 months pay stubs up to a few weeks before the interview.

If you only use your past years IRS 1040 statements then the W2s are required, anyone can download a blank 1040 from the IRS and fill it in with favorable info, the W2s are needed to prove the numbers on the 1040 forms.
