n400 taking too long at field office

Hi I filed my wife's case in may 2022 and I recently sent an inquiry to USCIS. I was got the reply below.

 

USCIS systems indicate that your case is awaiting an interview. Your local USCIS Field Office will contact you once they are able to schedule the appointment. Should you not be contacted by your local USCIS Field Office within 90 days of this notice, please reach out to the USCIS Contact Center for additional assistance.

 

I wanted to know what can be done cause its been over a year and I am still waiting for this process to be over. What are my options here?

Unfortunately, you appear to be in the 20% of Boston N400 cases that take more than 9 months to process.  Personally I would wait a bit longer before thinking of taking any action such as a writ of mandamus.

Makes sense. Yes we did file under 3 year rule.

This also requires IO who knows how to conduct marriage based N-400. Especially if you have pending I-751.

Right. Thank you for your input. Does it require me to be present there for her interview. Is it tougher/ trickier than usual n400 interview for us?

Yes, both LPR seeking naturalization and US citizen should attend. US citizen will likely not be allowed for N-400, but may be asked to join I-751.

 

It only gets tough or tricky if IO suspects immigration fraud or questions the marriage.

Let's just not create unnecessary fear which doesn't even need its implementation, where an OP just asked a simple question "why my application taking this long". First off, all IOs are trained pretty much to deal with any case type, sometime they do need a supervisor input if they find themselves stuck in deciding what to do. Marriage based, this based or that based, IOs know what they are doing and how to tackle cases with brain. Else about marriage fraud or sham marriages, application getting delayed isn't necessarily because of USCIS is considering a particular application a fraud. It could be million other reasons. People here doesn't need to be scared from the answers on the question they ask. Let's be easy in our responses.
